Classic Game Boy Color title Link’s Awakening has been recreated using the legendary Ocarina of Time’s game engine, with the jump to 3D sure to make for an interesting shift in gameplay and perspective, and likely to garner positive opinions from nostalgic players.

The remake is mostly being made by a single devoted individual who has worked on the project for over a year so far, unfortunately supplying Nintendo with another “heinous” fan-game to forcibly take down – the game can be followed via its Facebook page.

Seriously, it’s as if Nintendo fears that somewhere deep in the code there could be hidded a sexy scene involving Link and Zelda, or maybe even Link goatse.

And he also mentioned the story is “based on the original game AND the manga with some of my own ‘FAN FICTION’ in there”.

Murican law says that if a company doesn’t enforce its copyright, then it loses its copyright.
I bet Nintendo wouldn’t mind leaving fan projects be, but if they do they won’t be able to stop MS from ripping off Zelda and whatnot.

Compilation copyrights are ok. If a work was published without a copyright notice, the work could enter the public domain and would not have copyright protection. Any work that was in the public domain on January 1, 1978 remained in the public domain.
This needs to be stressed, for better or for worse, under US law the holder can wait half a century after the creator dies and have done jack s♥♥t and then turn around and have over two decades of hamfistedness because they feel like it.
Trademarks and to a much lesser extent patents, they want to you do some defending, but the monopoly granted by copyright is pretty much the strongest protections granted except for that if defended a trademark can already actually last forever.
That’s the corporate mindset unfortunately. Hopefully some people will be able to save it and share it once that does happen.
Unfortunately yes. They have the right to issue a Copyright Claim, and give the people time to remove content. Fair use says you can reuse copyright-protected material under certain circumstances without getting permission from the copyright owner, so he needed to ask Nintendo first.
