With two exceptions most states require actual penetration to occur for it to be considered rape, and registration as a sexual predator only occurs in such instances. Exceptions occur when the victim is a child (hardline stance there), or if the person is accused of sexual-themed abuse (example: forcibly masturbating on a person without penetration).
