Due to this, any sort of graphics that were produced without using actual live models, or those using live models that were not sexually abused is legal. (Similarly it is legal if the resulting graphics is not original but a derivative of two or more pictures, in where the original picture of the underage person contains no matter violating the above paragraph of the Code. It does not need to bear any express label that the material was produced by any of those methods; and it is the task of the State to prove guilty, not of the defendant to prove innocent, which, with the recent developments in computer graphics, might be a burdensome if not impossible task.)

I even double checked and it seems Hungary is still on the green list in the lolicon matter...
However the reason is rather because loli material in NOT distributed in any ways - as far as my experience goes - publicly...
No mags, no manga, no anime so far...Maybe some 'independent' merchandise is available but nothing more...

I live in the u.s. where our laws as far as i know are basically unknown to everyone even the government. This is just further proof that some people are actually figured out that the links between 2-D & 3-D is a matter of "Intent" in terms desire or 'attraction' in it's conception. It doesn't take a genius to figure out that that a 2-D image is simply a 2-D version of a 3-D fantasy - regardless of if there's a victim, it's INTENT!
When I look at "K-On!", "Haruhi", or "Ikki Tousen" I see them as 2-D versions of Idealized 3-D women. These 2-D creation don't get created in a vaccum. You need a 3-d comparison or atleast in the mind.
When I look at Mikuru or Eri Sawachika I see it as a drawing of attributes that look cute on a 3-d girl. I like boobs so someone like Mikuru is very sexy to me. I don't like undeveloped females. Something inside me actually gets 'Repulsed' at seeing little girls dressed 'seductively' (like child models)- it grosses me out.
Now, a fine line can be drawn with everything from Slasher Movies to Violent Bugs Bunny cartoons. Just cause you watch Slasher pics doesn't make you a 'Killer' and I've never dropped a safe or a bomb on someone's head. I think you need to understand the 'Motivation' behind each art form. You watch Horror films to "BE Scared" (like a rush) and kids watch cartoons cause "They're silly & Slapstick"....what could possibly be the 'Intent' of "SOME" (not all) Loli drawnings??

Good job, Ana! I didn't think legislation was that easy to find, but your post led me to search for my own country's laws on child pronography as well.
Unfortunately, Holland isn't as bright as Hungary, it seems. Although at least laws don't seem to be as strict as they are in Canada, US, etc. Apparently, owning images or owning a multimedia device or ither carrier that contains images of persons who have not yet or do not appear to have attained the age of 18 is forbidden by law and can be punished with imprisonment for a maximum of 4 years a fine of up to €76,000 ($99,280). This specifically does not include drawn or painted images,
although it is sometimes argued in court that it has to be obvious to a child that the pictures are no photos. I have to wonder about the effect of this criterium. Does it mean that owning images that are too realistic is prosecutable as well?
Moving on, there was one more thing that surprised me. Images that depict persons that are over 18, but have been photomanipulated to look like underaged persons are also considered child pornography. Isn't that essentially no different from prosecuting someone for owning drawn child porn? Fundamentally, neither involve harming a child. (Although it could be argued that the photomanipulation included material that did come from actual child porn.)

Gantz, freedom of sexual orientation is a fundamental right. It's okay to like people of the same sex, it's okay to like animals, and it's okay to like children. You're royally ignoring this by going on about people's intent. Or in other words, you can't be arrested if you tell the police that you're attracted to children. If the line between sexual orientation and sexual activity was blurred by court in the same manner you blur it, we'd be reintroduced to the concept of thought crime.
