    Golden's legislation, mirrored by a Joseph Lentol bill in the Assembly, would amend state law to say that "A person is guilty of possessing an obscene sexual performance by a child when, knowing the character and content thereof, he knowingly has in his possession or control, OR KNOWINGLY ACCESSES WITH INTENT TO VIEW (emphasis his), any obscene performance which includes sexual conduct by a child less than sixteen years of age. Possessing an obscene sexual performance by a child is a class E felony."

    “I have introduced this legislation so that we can properly prosecute those who view child pornography here in New York State. Federal regulations are already in place to see that those who access child pornography face the stricter standards of the law. New York must adopt these same policies,” said Golden, a former NYPD cop.

  3. it should be illegal to view child porn. accidental is one thing, that doesn't count, nor is any one saying it does, i know. but 2d isn't the same. no one is harmed in the making of it so it should be fine. Also I realize that everyone and their mother (maybe not their mother) has stated almost the same opinion or similar so I'm really just wasting my breath. That being said real pedos are gross and should be shot in the dick with a cannon loaded with chainsaws.

    LOL actually if i ever had the power to i already have it planned out. Take it over then say to those who crave to be controlled "Ok guy you can have this part of the world i'll take the other". Then set it up where the only crimes are theft unless it's to survive(like food when starving) and murder with things like assault being more strictly defined. Don't want people going to jail for a friendly fight now do we.

    Now give me control of the US and we're talking different things. First cut the military budget by about 3 billion(if i recall right it has a 7 billion one right now) divert that 3 billion to paying off our debts as a top priority. Once done transfer said money NOT to the army but to redoing the nations infrastructure and I mean it all with roads, high speed, trains and internet lines(with access ports for easy upgrades included gotta be ready for needing new lines). Start with select cities in each state and spread out from there. As for Alaska and Hawaii build train networks to connect the islands to one another and a GIANT chunnel(yes yes more complex than that. I am following simple explanation. though i have the chunnel covered as well and i left one out for Hawaii to the mainland for obvious reasons) from Alaska to the lower 48. Overall should take 50-100 years. Add in healthcare for EVERYONE involved in some way and bam near defacto universal healthcare. Leave it in the budget for repairs.

    Now as for extra needed money raise taxes on the rich while also removing them from those on minimum wage(ensuring financial growth) also raise minimum wage to a suitable level maybe 12.50 an hour.

    Also give people GURANTEED sick/maternal/paternal leave as well as ensured paid vacation time. Whiole making it so employers cannot legally overwork a person(I/E they can't just pile on a bunch of hours unless the person volunteers and even then)

    Now after all is said and done with the above plans then we divert any extra funding to the citizens AKA free money once a year. Tie that into ANY form of war and people will think twice about going to war unnecessarily.

    Unprivitize the prison system and legalize drugs and prostitution while taxing them.

    I guess one of the last things I'd do is return freedom to the people or at least internet by making it so whatever you view online is cool it's when you say download to your machine that you COULD get into trouble and even then not sure I'd wanna push that too hard. Oh and legalize weapons in general of course. As well as duels and return the right to SAY/DRAW/WRITE what you want maybe even increase it.

    So all in all my goal would be to create jobs of ALL types with the infrastructure plan, get americans used to the idea of having health care(while being funded by the tax increase)and trying to bring back INDIVIDUAL freedoms while limiting the power the wealthy exert.

    Funny thing is I KNOW I had other things thought out but I haven't eaten yet and well yeah not running on all cylinders right now. This is also a shorthand/simplified version but it should get the point across. My goal would i guess be to create a country with ensured work security similar to the EUs but with ensured individual freedom of the US of old. This way if you fail in life it really WILL be your fault and not the systems.

    To be fair, I don't think this changes much from the ruling you posted about in your OP. One of law's most important objectives is to protect the innocent. I think most educated people would agree that protecting the innocent is more important than prosecuting the guilty. (A more popular way up putting it is "I'd rather have ten criminals running free than one innocent person locked up.") The ruling in the OP dictates that images being present in a cache is not enough to find someone guilty of downloading child porn. This protects those who accidentally stumble across child porn. Even the article mentions that it "aims to distinguish between individuals who see an image of child pornography online versus those who actively download and store such images", even though the sensationalistic heading of the article seems to suggest otherwise. I'm sure that people who do actively visit child porn sites without saving anything could still be prosecuted. The prosecutor's office will just have to put some more effort into proving it.

    With the amendment in the post I quoted passing, this distinguishment between active and passive viewing is simply cleared up a bit.
