Animation studio Plumeau (based in Utrecht, Netherlands) has blamed developer Grasshopper Manufacture for using a chunk of their studio’s animation without permission in the latest trailer for No More Heroes 3.

Initial reactions to this reveal (before the Envato debacle was uncovered) has been mostly negative towards Grasshopper, deriding the studio for their actions with there being few of the opinion that Studio Plumeau is in the wrong:

Says the person who used a copyrighted picture and a copyrighted catchphrase to have any say in the matter but who knows it’s like the pot calling the kettle black.
Well, they aren’t trying to sell a product using said copyrighted picture and catchphrase, nor are they trying to claim them as original works. Which means it safely falls into the “fair use” category. You know, just like the millions of other people who legally use the works of others to express themselves.

Copyright doesn’t care about whether you make money or not. That’s why you are not allowed to buy a book, copy it and then give it away to someone else for free. Neither are you allowed to use the likeness of for example Samus Aran and make your own Metroid game, then give it away for free. Copyright makes this stuff illegal.

I suggest you look up “Fair Use”, failure-at-everything.
Fair Use is exclusive to the US. As far as I know, no other country has this. And yes, using avatars like mine is infringing on copyright. It’s just that nobody gives a f♥♥k about this and it’s not like anybody would lose copyright over not enforcing it.
So now light saber battle animations are now copyrighted. So now I’m copyrighting what you said as my own words since you didn’t lay claim to it.
They may not have acted criminally but since the dude who sold it had no right to sell it, they had no right to use it. They are liable for damages.
