Not exactly - I'm saying that if the punishment is JUST AS BAD as the punishment you get for a more serious crime, then there's less reason NOT to do a more serious crime.
Consider this: a lot of people, when there's a news story of some instance of statutory rape, say things like "well, we should just kill all the pedos or cut their dicks off" or whatever. Well, and in some prisons, pedos may very well get attacked or killed.
So if you slip up and make out with some underage girl, and then you realize that if you get caught you won't JUST get jail time, but you might get a death sentence from some lynch mob or other prisoners, then it becomes easier to consider taking drastic measures to keep from getting caught - like silencing witnesses. After all, you might already be facing the same kind of punishment we give to murderers, so what do you have to lose?
People keep thinking of punishment as a deterrent, and lots of people are in favor of making punishments harsher and harsher, supposedly as bigger deterrents. But in an objective, practical sense, there's little reason to believe it actually works like that.
