Japan Child Porn Ban “Will Destroy Anime & Manga”

Japan’s anime and manga industry is warning that a newly proposed law which has the potential to ban many 2D works as child pornography could devastate the industry and make freedom of expression a thing of the past in Japan.

The new law would constitute Japan’s first national ban on “simple possession” of material deemed to feature minors (although distributing and creating such material has long been banned), with penalties of up to a year in prison and a million yen in fines.

No explicit mention is made of the extent to which the law applies to fictional works, and the general assumption is that it will apply universally even to 2D imagery.

As usual with Japan’s censorship regime, the law barely defines what it will actually be banning, mentioning only “obscene” material featuring participants who “resemble” under-18s, with the determination of what constitutes child pornography thus left entirely to police.

A wide-ranging Internet censorship regime is also mandated by the law, as is a “research group to study the harm caused by manga, anime, games, CGI and other material resembling child pornography to the rights of children” – the latter proposal being a particular red flag to anyone who might have otherwise thought they would stop at 3D.

The law’s sponsors are the usual suspects – the newly resurgent ruling Liberal Democratic party (Abe is known as a personal friend of no less than Agnes Chan herself), enthusiastic whoremonger Hashimoto and geriatric sex novelist Ishihara’s stooges in the Japan Restoration Party, and the Koumeito, the political arm of the Soka Gakkai cult.

Among the most vocal opponents of the law has been “Your Party” (Minna no Tou – a libertarian LDP splinter party which recently annoyed rightists by disowning an alliance with Hashimoto over his unhealthy obsession with comfort women) diet member Taro Yamada, who explains why he thinks the law is an awful idea:

The present law restricts pornography featuring real children. By extension, there is no ban on fictional children. This amendment has the potential to be applied to fictional children.

The original intent of this law was to prevent child abuse. But with these amendments, who does it protect? Children in manga do not exist, are not victims, and so of course cannot be protected.

This law will likely only promote the decline of manga – similar laws in Korea have had a highly adverse affect on their manga culture.

Consider the case of that scene with Shizuka-chan bathing. It is said that it will not be covered by the law. But how far the new amendment can be taken is not stipulated, so creators will be afraid to even draw a scene like it in case they are prosecuted.

Additionally, the people who will judge whether the Shizuka-chan scene constitutes child pornography and then arrest its creators are essentially police and prosecutors.

You’ll never know if they are planning to arrest you, and the criteria for what they consider child pornography are vague and ambiguous, so you can hardly continue to freely create under these conditions.

Of course, there are those who are uncomfortable with the sexual representations of minors which do exist in manga and so on at present – but under existing laws obscenity prosecutions are made, and a more extreme crackdown is hardly required.

Just banning things you find disagreeable is no different to banning natto because you don’t like that taste. I don’t like natto but I don’t want to ban it, just not eating it is fine. People need to understand it is the same issue as with banning TV dramas featuring nasty murders.

Finally, at today’s explanation of this law, its promoter conceded to me that the law’s intent was to protect real children, but that there is no demonstrable link between pornographic manga and the like and actual crime.

His latest update explains there is still hope that the bill will fail:

The future passage of this law is not clear, but this is likely:

1. It will pass in deliberations of the lower house’s Committee on Judicial Affairs

2. It will pass in deliberations of the lower house’s regular session

3. It may be rejected in deliberations of the upper house’s Committee on Judicial Affairs

4. It will then be subject to deliberation in the upper house’s regular session

The main points being:

•The Committee on Judicial Affairs has a lot of cabinet proposals to deliberate on, so it may not get through them this session. However, in the lower house there is only one bill left, so it may get past into regular deliberation.

•The opposition is strong in the upper house, the bill may not even get to the deliberation phase before they run out of time.

•If this happens, it will become just another abandoned bill.

According to my information, voluntary restrictions are already being put in place:

•Manga illustration guides have been dropped from search engines

•A large auction site [Yahoo! Auctions] has even banned auctions featuring pictures of school uniforms, child clothing, randosel [In fact Yahoo has gone so far as to ban even titles alluding to such content…]

•A major search engine has stated that if the law passes they will have no choice but to ban a great many pictures of manga and actual children

•The latest edition of Dragon Ball has cut scenes featuring bloomers cut

With simple possession applied to manga and anime we’re entering scary territory, with wide-ranging restrictions on freedom of expression. I am firmly of the opinion this infringes on constitutionally guaranteed freedom of expression. Your Party and other opposition parties intend to strengthen our opposition to this law over the coming days, I’ll keep you informed.

We’ll fight on with you to the last.

The ill-advisedly named “Japan Cartoonists Association” (in Japanese their name is the more credible “Japan Mangaka Association”), one of the few NPOs the industry operates in defence of its interests, has also issued a lengthy statement condemning the law.

They condemn the law’s application to 2D works as “tantamount to book burning” and not only a violation of freedom of expression but also the reader’s “freedom of knowledge,” and warn it will damage the industry and is more than a little reminiscent of Japan’s pre-war censorship regime.

JAniCA, the Japan Magazine Publishers Association, Japan Book Publishers Association and Comiket’s organisers have all also joined in condemning the law.

The online reaction is no less scathing:

  • I’d advise attacking the people behind this law. Not literally, of course, but rather exposing them for what they are.

    You see, it goes all the way back to the “Dark Ages” (being western here, vely much wisdom, glasshoppa) good old days of face tumors, not bathing, constant bully knights fighting and beating peasants in between huns invading and plague and witch burning.

    The local authorities were turds and shit, excuse the “French” (who RUINED everything!)(1) but they were no good at any other than fighting each other and the priests babbling from memory of recitals of the bible and butt fucking each other and any orphan boys they could catch. So people came to them when the taxes were so high people starved, and then there was a drought and people starved and they wanted MORE taxes and they asked the priest why the plague struck down wicked and righteous, why they banned the “Lightning Rod” though it struck the church 3 times+ yearly and burnt it down and more taxes paid for it but not ONCE did it strike the bawdy house or the gambling den…

    Actually, 3D does NOT have to have an actual child involved.

    Real-life pictures of children in sexual situations have to have a child involved. 3D pictures can be based on computer models, Hentai-Foundry has some sterling examples of 3D images with no real child involved.

    This whole anti-pedosexuality bunkus is about creating a new boogie man for society, as I have pointed out numerous times before.
    It’s not about protecting children, children can do that themselves by telling their parents if someone has tried to touch them sexually against their will.
    With their will? That is their own business and shouldn’t be illegal.

    Even though I find this kind of depiction of underage children disgusting even I’m smart enough to know that banning it wont help anyone. In fact since they’ve been putting this stuff out in Japan so long these people who’ve been getting off to it will probably start going after real children. It’ll end up being a giant pedocolypse.

    Right now, Japan is caught in a Catch-22 here because they voted in a LDP majority with China beating its military chest right now because the DPJ would be pushovers to the rhetoric coming from Beijing, but then the LDP pulls this crap every time. Hopefully this gets put in the shredder & good luck to Minna no Tou in leading the fight against it.

    Why is it always one step forward and two steps back for Japan? They propose a law that will FINALLY seal that loophole on possessing child pornography once and for all…but of course they have to go and write the vaguest guidelines they possibly could.

    Then, as if that weren’t enough, they show honest-to-god signs of gearing up for a full-on war, NOT with photographed and video material of ACTUAL ABUSED MINORS…but with a series of lines and colors that vaguely resemble children.

    Honestly, I was once shocked, then I was enraged, then I was bitter. Now, I’m just tired. Clearly, Japan hates this massively popular entertainment movement that they are wholly responsible for creating and that is garnering them the admiration of animation fans the world over.

    I suppose if they want to destroy one of their biggest cultural footholds in the world, that’s their business. I’m too emotionally exhausted to care anymore.

    Speaking of which, if I had the funds I’d design a audio/video/camera app which does not record to flash memory, instead it uploads the files directly to a remote server.     What most people don’t seem to get is that when it comes to the governments of places like Korea and Japan, they are run almost exclusively by old fogeys who have deep rooted feelings in their past; World War, Nanking, etc. Although that’s part of the problem, their main schtick is that they fucking HATE their new generation and they are paranoid about the way others see them.

    Look at Hetalia, it was a massive white washing of Japan’s crimes.

    They’re incredibly nationalistic and their people don’t really get a say in it. Much like the Chinese populace, nobody really speaks out against it because they want to avoid problems and they are just generally too passive.

    • BL is also affected. There have already been some artists who were cancelled publication because their characters were wearing school uniforms in one of those past attempts at such a bill. It was pretty damn retarded.
      If it passed, it probably wouldnt have that much of an impact on the actual anime and manga themselves, with the exception of extreme examples like To-love-ru. But it would completely murder the doujinshi industry, which would have terrible consequences.

    Most of that stuff can’t be imported to the USA unless you eventually want to be arrested anyway.
    Like the Da Capo series of Visual Novels. The Anime was fine for all the seasons it had but the Visual Novels had a load of under age sex in parts of it plus the add on expansion pack for one had enough in it to not even open or look at what was in it on the store sales page. Also the old series we all loved with was Shuffle! I am pretty sure the full Japanese version of this visual novel is beyond what is allowed in the USA (if you dont want to get arrested eventually) but the re issue with english subtitles was a safe version. Just expamples of how far it would go there in Japan.
    So what are or would the Japanese do with all the stuff they already bought and own plus have owned in some cases for more than 25 years? Would they get life sentences since theres proof they bought it on some sales recipt or shipping list from a company or would the make a grandfather clause for them?

If a girl gets pregnant before 18 her life is pretty much guaranteed to be over in today’s society, for completely logical reasons. This is the fundamental reason for the age of consent. It’s bad enough that teens are already having sex with other teens, any more freedoms to allow and accept them having sex, and we’d see teenage pregnancies soar.

Like the Tokyo Youth Ordinances, this bill would hand wide-sweeping authority to a small body of political elite to declare fictional works illegal essentially at will. Even if the law is not invoked immediately to arrest half of Japan’s manga industry, it gives the government the selective ability to arrest and incarcerate any manga-ka, artist, or general citizen in possession of any material which can be defined as objectionable. However, if you have the potential to act on 3D in a negative manner, perhaps maybe you should switch to 2D, considering there are no real people involved in that.

The last time an anime moved me to tears was years ago but now i just try to not fall asleep with all the school girls being moe.
