Otaku Musician Busted for JK Fan Sex: “I Met Her At Comiket”

An otaku musician famous on NicoNico Douga has been arrested for having sex with an underage fan who approached him at Comiket.
The 31-year-old Tokyo musician enjoyed modest fame through his music on NicoNico Douga, released under the name “Hoshimi Aoto.”
However, his popularity was his undoing – a 17-year-old female high schooler approached him whilst he was attending a Comiket music booth, and proved more than willing to express her appreciation for his talents amorously.
The pair indulged in carnal relations at a hotel in the Tokyo city of Chofu, a matter which somehow came to the attention of the authorities.
He was subsequently arrested and charged with engaging in indecent activities with a minor, which he admitted, saying “I thought it was risky but I couldn’t restrain my lust.”
Aside from its enjoyably lurid aspects, the case has been attracting attention for another reason – the stark contrast between “ideal and actuality” offered by pictures of the musician whilst being arrested for his vile deeds and his online 2D portrayal:

The national age of consent in Japan is 13 as specified by the Japanese Penal Code Articles 176 and 177. However, prefectures can (and do) have dumb laws (ordinances) that prohibit sexual activities with any minor under 18.
The Japanese age of consent is a qualitative thing - like it can vary. When I worked there, I was warned upon first arriving that despite 14 being the age often quoted (not that I'd want to engage in those acts with someone so young anyway!) to treat 18 as the age, because that's the age it becomes beyond reproach.
If you want to be really really sure you must wait until they are 21 (and obviusly don't approach to them nor be seen by them, they are the ones that must approach to you).

Age of consent in Japan is thirteen, but prefectures can override it up to eighteen. Usually it's sixteen, but not necessarily and can be different for men and women, or depend on the kind of sex (although being a foreigner is equivalent to doing the worst imaginable act).
Also, paying someone under eighteen for sex is illegal.

No, he should have his name on a plaque for his achievements. What he did was illegal. Simple as that. People go to jail for marijuana, and I doubt that too is a good enough reason.
It's not as simple as that. If laws were a set of rigid rules, upon the breaking of which a suspect simply was thrown into jail, then what in principle, is the need of courts? Why don't policemen dispense justice on sight? I'm sure what a wonderful society that would have been.
Remember that laws are nothing but regulations written by politicians. In so far as they protect lives and property, they need to be enforced. But when a law is unjust and ludicrous and concerns a crime for which there is no victimized party, it needs to be fought against the same way as tyranny. Here we have a case of two consenting ADULTS (17 is an adult age as any) engaging in a private, mutually agreed upon act. Although this might be a particular case in Japan, thousands of people get incarcerated in the West for trivial reasons with nobody hurt by their supposed offenses. Does the public get outraged and come to their defense? No, instead they rationalize, if a suspect committed an offense against an existing law, then it automatically follows that he is morally culpable of a great offense of breaking said law, because it's the law.
Remember it was illegal to aid an escaping slave in the 1860's and even now, in some places it's against the law for a woman to take off her face covering rag on pain of death. In so far as they are stupid and harmful, such laws exist to be broken and fought against. The fact that something is a law does not imply that it is just or moral or helps improve public welfare in any way.
So next time you gloat over an innocent person getting thrown in jail, remember it could be you soon. Under your standard of justice, there's no such thing as innocence, only degrees of guilt.

16 in Texas and Florida. I think Federally 18 is universal in the US, but States are given some degree of leeway on self-governance and that include marital affairs. Some are a little weird though. For example marital consent age being lower than consensual sexual congress age limitations. I'm not really sure how that's enforced, but it *is* rather hilarious.

IMO biologically 13 is fine, but socially creepy. 16+ seems fine though, especially given females reaching maturity sooner than males. Hell most men are still children well into their 30s.
