Police have busted a naked policeman found tied up on stage in a BDSM sex club, charging him with public indecency – apparently on the grounds that the club was not a properly lisensed brothel.
The incident occurred in Sapporo when a 28-year-old head warden at a local police station paid a visit to a BDSM club named “Club Patio,” situated in the centre of town.
He took to the stage, took off his clothes, and was bound in place with a red rope by a female member of staff, when police suddenly raided the premises.
The officer was subsequently taken into custody at 1:25AM on charges of public indecency.
He admits the charges, saying “there was no doubt that I was naked at the time,” although at the time of his arrest he was apparently not forthcoming about the fact he was a police officer as well.
Police say there were “about 15” male and female patrons at the establishment watching his on-stage antics when they arrested him.
Police explained their own presence at the club by saying that they were investigating the club for providing sexual services when they only had a late-night restaurant license (brothels and sex clubs normally have to pay to “register” with police if they wish to remain unmolested).
The rather lurid details of the incident and the pathetic way in which Japanese police shake down brothels by “licensing” them has provoked much comment online:

They say "public" because for them nothing is really private.
It's public because it's open to the general public. It doesn't mean ownership in this case.

Public place includes any and all businesses that are open to the public, such as restaurants, bars, dance clubs, the malls.. in Sapporo, clubs that have sexual fetish services must be licensed for this - it affects the age allowed for patrons, age allowed for workers at that club, and also includes health ordinances specific for brothels - the license is important and this club apparently did NOT have the correct license for the content they were offering. Personally i know that sadism and masochism are both unhealthy sexual disorders - i find bdsm disgusting - but i also understand how the law works - the clubs were operating in violation of the law because they had not registered for the content they were offering at the club.

It sounds like everyone involved is a consenting adult and they are doing this stuff inside on private property. Why bother them? They're just having fun.

The Tokyo Metropolitan Police Department have to be some of the best police I've seen in action, because when they apprehend someone they don't treat them like animals, but like human beings. I've seen far, far worse police in other Countries.

As for politeness, sometimes that isn't good either. They were way too mellow against that Akihabara stabber for example.
You bring up some good points, but not ALL of them use those tactics. That Akihabara incident isn't a good example because they didn't search him properly, but they never took him down like some animal with a gun to his back. If that Akihabara stabber incident was in some other Country he definitely would've been full of bullet holes.

since it was a BDSM club i would say, more like being arrested for being naked in a sewer. But the actual issue in the report is that the club (which is considered a public place because it is open to the public) was NOT licensed to be offering sex content - the licenses are important, they determine the age of patrons, age of workers, and extra health issues that come from letting the public get naked and have sex in your club.
In some countries its illegal to be naked in the bathroom so...

the club is considered a public place because it is open to the public. It offers a club service to the public = public place. Shops, dance clubs, bars.. all are public places by definition of their service.
