Keeping the 3DS unconnected is the best option to avoide get fu**ed by nintendo. Without conection you avoid to get tracked and the annoying updates that would "kill" the backup cartridges (A backup cart is essential If you don't want to spend money on crap games).
3ds will autoconnect to wifi without user's permission. The best you can do is to avoid any WIFI area
There's a button on the right side of the console to disable the wireless, to "save batteries" among other things.
