Murder charges against a woman who stabbed an old lady to death for no reason have been dropped and the woman released, despite accusations that the murder was premeditated.
The incident began with a 23-year-old woman loitering about a Nagoya subway station; she approached an 81-year-old woman, and using a 16cm kitchen knife stabbed her 40 times in the head and back.
She was soon arrested and charged with murder, and freely admitted the stabbing – “There’s no doubt I did it. I killed the old lady with a knife.”
However, her other statements were rather less clear – “My father gave birth to me today. I have no name.”
As a result of these utterances she was detained whilst her mental state was evaluated, but it was decided she was not mentally fit to stand trial.
Her parents also report she was living alone and had been undergoing treatment for schizophrenia at the time of the crime.
As she could not be prosecuted and could not be held any longer, she was released on the 21st of Janurary and placed under court-ordered medical observation, although it is not clear how long she will be detained for.
Japanese law, in common with that of most nations, stipulates those of unsound mind not be prosecuted for their crimes – although usually courts would not be so shy about ordering indefinite hospitalisation of the perpetrator of so serious a crime.
The family of her victim are unsurprisingly dissatisfied with the verdict and are demanding an inquest:
“It’s very unfortunate, and we’re not convinced. She clearly prepared for the killing by taking the knife with her and deliberately selected a victim weaker than herself. We’re not convinced it wasn’t premeditated.”

Wow Japan ... what can i say. I'm sorry for the old lady :-(
If she gets released from the court-ordered medical observation, i bet she will stab and kill someone again.
Sooner or later.
This is but a glimpse of the things to happen in K-ON!!!
Ui and Yui (along with the rest of the K-ON! band members) are now office ladies who are fresh out of universities.
On day, Ui follows her sister, Yui and finds an old lady giving her food. The act of kindness was viewed by Ui as a threat to her dear onee-chan and decides to murder the old lady.
After following said old lady, she kills her with a knife and fakes her mental illness.
The judge then has no choice but to drop the case against her and Ui eventually goes back home and decides to kill anyone who will take her precious onee-chan away from her.
THE END~
Yandere Ui is sooo cuuuute! (~ ̄▽ ̄)~ ♥
Everyone really wants Ui to be a yandere [http://danbooru.donmai.us/post?tags=Hirasawa_Ui Yandere&searchDefault=Search] huh [http://danbooru.donmai.us/post/show/789643/bed-brown_eyes-brown_hair-computer-crack-crazy-cra]?
Not so. The fact is that people who are judged mentally incompetent, get treatment and are released are VERY unlikely to reoffend.
Less even than regular criminals who get various kinds of help to turn away from a 'life of crime', which is only in that case about 10% reoffend.
Biggest question is...Why was she outside to begin with?

"Her parents also report she was living alone and had been undergoing treatment for schizophrenia at the time of the crime."
WHY THE F*CK HER PARENTS LEFT HER ALONE?
Trial to the Parents instead since they're so stupid for not being with their schizoprenic daughter.. If they were there then that daughter of theirs wouldn't kill that Old lady
While that may be so, that's of no consolation to the families of the victims. That kind of ruling ONLY looks at the mentally ill's family. That is just literally not fair. There has to be certain concessions to guarantee the victims' families that it won't be repeated again. Just letting them loose under loosely controlled governmental observation is pretty open in how it works it seems. Sometimes the treatment works. At other times, they can re-offend. There's no guarantee there for the victims at all.
The funny part is how detaining that mentally insane lady (or shall I say, DEMON) could potentially be very beneficial for HER.
And needless to say, that old lady gets ZERO JUSTICE for it. I'd say it doesn't matter if you're the most mentally f'd up person in the Earth. If you kill someone, that's the threshold. Off to jail/treatment you go. Preferably for good, if it's something so serious you'd kill an innocent human being for it.
This is just all kinds of sad. Sad to see the bureaucracy-loving Japan put up another bad name for bureaucracy. How many deaths and outrageous decisions will it take for change?
Exactly. Don't the have a psycho prison to go to?
The only thing in this post that made my day is the yandere Ui pic. The pic really surprised me. I never thought Artefact would use it one day. I will never know where all this yandere Ui shenanigans came from. when it started, and why everyone wants Ui to be a yandere but oh well... YANDERE UI FTW!!!
“My father gave birth to me today. I have no name.”
Chii
Its their way of thanking her for easing their aging population's burden.
Yandere is not affected by law.
Japan, land of freedom... for any psycho

but wat about schizos? Ppl with two or mre personalitis? I think thats wat is hapening here, personality a(the original personality) is innocent of the killing and has no idea of it, personality b(the second)is the one who wanted to kill and did the actual kill, who and how do you serve justice? Two genuine ppl in one body, punish the guilty and condemn the innocent,
Jus sayin that nothing is ever cut and dry
If she's truly crazy (can't tell wrong from right), then the offender shouldn't stand trial, BUT, as a danger to society, she shouldn't be released into the general world.
Bureaucrat: "Well, I don't know who's going to pay for the offender's treatment, so just release her."
If nothing else, this is certainly a sterling opportunity for some local Yakuza to earn community support.
The law may have forgiven her, but that doesn't mean her neighbors will.
Yea, everything's just dandy until she meets another old lady....
"a woman who stabbed an old lady to death for no reason"
What. The. Fuck.
I whole-heartedly agree with you. I hate to see swift justice going unserved in instances where it's clearly a cut and dry situation. This woman is a menace to society, even if she never kills anyone again she still took the life of another innocent human being and received no ramifications. It's sad to see how the legal system releases as many guilty people as it punishes.
Chill people. Send some money to the sanitarium instead.
Hey, who got Death Note here?
Oh shit, we dun have her real name.
Yup poor old lady...
Btw its kinda ironic that Ui holding an onion.
In Dutch onion means ui. So Ui holding an ui xD.
thats just how stupid people are "sure she is a cold bloded killer but also mentaly ill, so lets just let her be and kill anyone"
Stabbed her 40 times? Clearly an accident
'Wow Japan' you said?
This type of occurances happen all over the world, not just Japan. Where have you been living in? A cave with no outside contact?
And, yes, her deliberately carrying a knife and choosing to kill someone who has the least strength to fight back may seem cunning, but that's not real proof that she's sane enough.
I mean, c'mon... It's natural to hate someone who killed the person you care so much, but you want to claim being better at psychology than the guys who basically learned that thing since college and are deemed fit to judge that by the goddamned government?
Laws, man. We ain't living in the stone age no more. Otherwise, you can just kill everyone for whatever reason. Eye for an eye makes the whole world blind.
Not only Japan. The same rules applies here in Sweden and most other countries too.
Schizophrenia isn't such benign a condition that you could let the patient live alone. That's just plain irresponsible.
Maybe his hand slipped 40 times? It happens sometimes.
Okay guys
I am going to Japan and killing over 100 people
When I get caught I will tell them I am a frustrated Magikarp that wanted to be a Gyarados.
Don't worry I will be out in a year and do it again.
Give 'em hell, anon.
Detain her in a mental hospital (asylum, whatever). It's not rocket science.
in Japan if you kill someone they release you but if kill yourself they sentence you to the electric chair
that makes sense
"..if kill yourself they sentence you to the electric chair."
"Yo dawg" or "Kill him till he die"....?
She was Ishihara's wife.
He is the next.
schizophrenia. it's a bitch.
I feel sad for both, the shizophrenic woman and the old lady.
Shizophreny can be a true curse, as I have seen it myself. One of my friends is shizophrenic and I could see that she suffered under it. She tried to kill herself numerous times to flee from that madness.
Learn to forgive others, as revenge would only lead to another needless bloodshed. Seriously...
As for punishment, atonement is the best choise, as killing the murder doesn't bring back the beloved ones.
I have a friend who has Schizophrenia as well and his life is a mess. He once was a perfectly normal person, healthy, good career. Some time later he started to become an insomniac, didn't sleep for months and his mental state started to deteriorate, signs of paranoia, anxiety, fear, irrational thought clouded his judgment. He began doing strange things like walking barefoot for long distances until his feet were bloody and blistered. After a violent incident he was detained at a mental institute but escaped after attacking the guards. He was then caught again and put into a hospital mental ward for treatment. When i saw him on his 21st birthday at the hospital i broke down inside, he lost everything and all i could see in his bright blue pale eyes was emptiness he was just a shell of his former self.
Your description is too poetic to be real.
Dude, you obviously have not experienced shit in your life if you completely dismiss it just like that. Shit happens unfortunately. I myself have bipolar disorder, and let me tell you that compounded with other factors, it is fucking hell. But I'm learning to cope with it. Sadly, the person referenced above couldn't cope with it, and if this article's story holds true, then that young woman who stabbed the old woman, just couldn't cope with it. When you have a mental illness, your brain chemical balance becomes fucked and that's when a lot of shit happens.
They don't have involuntary commitment in Japan? What the hell do they do with all their psychonutjobs? In the US, it's been shown that those who successfully plead insanity spend more time in the nuthouse than they would have incarcerated for their crimes on average.
Yeah, that seems WEIRD! The fact is that ANY country should have involuntary commitment. To not have it seems stupid, or is it that they would rather these people kill and the people who they kill are 'worth less' than the money that would have to be spent to treat these people.
look at the languages section in wikipedia. actually very few countries have involuntary commitment. In the Ukraine there is nothing like this.
Japanese police have better things to deal with like fansubs.
Same old story, different country. Another mentally ill person living alone and unsupervised goes off their meds and kills someone. The medical community shrugs its shoulders, the government only cares now that a law has been broken. Now she'll get the medical attention she needed, but who cares that an old lady had to die that way?
Laws are there mainly as pretext though.
In today's world, laws don't matter. CONSTITUTIONS even, don't matter. What matters is that the society is made to be 'in order', or at least, in the way that the politicians want us to be.
It's happened before; some guy gets accused for murder in a controversial, slightly extraordinary circumstance. For some reason, the majority of society who didn't even follow the trial assume that the guy is guilty until proven innocent(which they wouldn't have known anyway). They rage so much to the point that people take it up to the streets to see him hanged. Later on, the judge ruled that even though all evidence lean towards the guy not doing it, he still goes to the gallows to 'preserve public interest'.
That shit about executives and judiciary being seperate in a rightfully democratic country? Bullshit, because no country today is truly democratic. Politicians will continue to amend laws for their benefit until war breaks out, destroys the country, they build it again and repeat the law rewriting.
Wise words!
Well, only one thing to do.
Take up vigilantism. And claim insanity when caught.
Oh Japan and your crazy laws! You ban anime and manga because you think it's wrong, but you release a killer to kill more peoples instead to put her in an asylum.
I don't think she is release but kept under medical observation...
Dude, U MAD? She's kept under medical observation. Can't you read?
