18-Year-Old Busted for “Selling Child Porn” of Herself

An 18-year-old girl has been arrested on child pornography charges for selling nude pictures of herself online.

The girl, an 18-year-old unemployed resident of Saitama, was arrested on charges of selling child pornography after she sold nude pictures of herself to men online using an Internet bulletin board.

Reportedly, from December of 2009 to April of 2010 she took a number of pictures of herself naked with her cellphone, in one case selling 33 to a pair of patrons for ¥12,000.

She identified customer bank accounts, allowing police to identify 147 customers who paid her a total of ¥1,070,000 ($12,000). It is not clear whether police will be pursuing charges against them.

She admits the charges, saying she used the money to pay her rent and food bills as she had left home.

18-year-olds, though still technically minors under Japanese law, are perfectly legal to portray pornographically in Japan – although unconfirmed, observers think the most likely explanation for her arrest is that some of the photographs were of her when she was still 17, though naturally this hardly constitutes “child pornography” in the eyes of most.

The arrest has proven contentious amongst Japanese – some have denounced it as a typical abuse of a bad law in order to terrorise minors into chastity, whilst others express disgust at police and mass media which insist on calling an 18-year-old a “shoujo” instead of a young woman. None can identify a victim involved in the crime.

Ironically, she would not have faced any charges had she just had sex with the men for money, or sold them her pantsu, even if she was a minor at the time – Japanese police never take legal action against “child” prostitutes, except apparently when they happen to take pictures of themselves.

Even more ironically, in most parts of Japan a schoolgirl can be procured for much less than the patrons mentioned paid for a few dirty snaps…

    • well same thing in america if your under 18, but you don;t have to sell it for it to be child porn, you could just be sexting nude pics to your boyfriend and it would be distributing child porn, the receiving end would be charged for getting it and the sender is the distributor.

      That could come under a Consumer Court rather than Criminal Court, although free market laws still do apply.

      If the prices are too unreasonable, she would end up being boycotted. Though she might be appealing to altruistic nature (or sugar daddy nature) in people who pay too much for simple (low-value/valueless?) things as well.

      Consumers however also need general education (and reminders perhaps in media instead of all that useless and harmful subliminals and propaganda) that should be included in school ‘Social Studies’ syllabuses as well. Maybe a chapter on demanding receipts, real vs. apparent value and impulse purchases with this very case as an example . . .

    But last I checked, age of consent in Japan is 14, I’ve seen 15 and 16 year old gravure models, you can leave school and hold a job at 15, you can be in AVs at 18, and this WOMAN was already living on her own and out of school… HOW are they charging her with CHILD porn?

    This reminds me of how recently I was told I couldn’t be an adult chaperone for my 13 year old sister and her 13/14 year old friends, because apparently “19 is still a child”. I guess just because my sister and her friends are taller than me, EVEN THOUGH I have a legal State Identification Card that says I am an adult, registered to vote, and am an organ donor, I am “still a child”… *stares at Japan AND Australia for that matter*…

    Once you reach the age of consent for your state/country it shouldn’t matter how old your partner is because you are, by law, technically old enough to be able to handle such decisions.
    So they should either scrap the sex with minors and change it to sex with under age of consent, or just move the age of consent up to when you are no longer considered a minor by law.
    I’m positive everyone but moral-fags and religious-fags will choose the former.

  • Ah, CP. Always a hot topic for freedom of expression and what-not. Now, I don’t know about the nuances of the American Constitution and their Bill of Rights, but I know for certain that in Canada, our rights and freedoms are not absolute. The government can set limits to those rights and freedoms, it’s just that they need to be ‘reasonable’ limits. Take a case about harmful messages on cigarette packets. A company tried to say that being made to put messages about the dangers of smoking was against their freedom of expression, in this case the freedom to not say something. The courts agreed with them that their right was violated, but also concluded the government had a right to protect the general public against the hazards of smoking which took precedent over their right of (not) expressing something. The point is, if you don’t like it, write to your local government representative and tell them to change things, or get out of your democratic country if you’re so fed up with the “rediculous” laws.

      Even children should have the right to consent to sexual activities, as long as they have had sexual education classes, which should be VERY nitty-gritty and in-depth at about the age of 2, as my sex education to my children was.

    She's 18 and she can do with her body what she wants. It shouldn't matter how old she in the pictures are because it's her body, she's an adult, and she's even the one distributing

    I thought these laws were supposed to help KIDS.
    They should be giving her help with money to pay the life expenses she's been doing this to be dealing with, not ruining her life which is apparently not the most wealthy and smooth and pampered of them all.

    I was kinda tempted to do this same thing when I was a kid out of being a rebellious teenager but didn't have the guts and never had the type of personality that would want to camwhore pictures of myself out on the internet or the like. Plus I had slow internet and wouldn't have known who to give them to. And now I understand those fears were exactly as dire as I would have imagined. I could have indeed gotten into MAJOR trouble over this pathetic bull. I can't even believe this, it's not like some ephebo would have been harming anything by getting off to them if I took them anyway.       The way it’s meant to work isn’t “When they turn (insert age) they’re mature enough”, it’s “by the time they’re (insert age) they should be mature enough”. Of course, there are problems like children maturing well before that age, and the fact that’s it’s the law brings difficulty in making exceptions. It’s far from a perfect system, but there’s no realistically equally regulatable substitute.

        However, for a law to be clear, you have to pick an age, whatever that age may be.

          I think the problem is the assumption that the law must contain some mention of an age.

          If teens want to fuck, I’d say hand them some condoms and let them be. Why does the law have to mess with their private affairs? The only people that can potentially be harmed are those who willingly accepted to participate. If they end up regretting it, well, that’s their problem. The purpose of law is not to protect people from their own stupidity, it is to prevent people from abusing others.

      tl;dr warning…

      I’ve been thinking about it a lot, but no matter what, I couldn’t come up with a half-way reasonable way to regulate such a market. The enormous sums of money involved will bring in so much corruption that any attempt at enforcing the regulations would be a joke, especially those making sure the children have actually given consent (how would you even begin to reliably make sure of that anyway?).

      The best I managed to come up with, assuming some crazy utopia where the state and the people who work for it are actually committed to the people’s happiness and well-being instead of money and power, is this:
      There’d be some sort of application the child her/himself would have to submit to the police or an appropriate ministry (it’s important not to make an new agency for it so that it will be covered by existing, well-implemented anti-corruption efforts), which in turn would run a background check on the child’s family and/or guardians and delegate a public health officer to check if the child has already begun puberty. If all conditions are met, the child would be allowed to do porn.
      The system could be expanded to include safeguards for all kinds of sexual activity. For example, regular health and background checks would be necessary if the child wants the license extended. If bruising or other signs of abuse are visible, police could intervene immediately. If the child plans to take part in, say, BDSM play, another application would have to be filed so that police knows what’s going on if there are bruises, rope marks/burns or similar. (Note that this doesn’t give producers a get out of jail free card. If the child complains afterwards, it doesn’t matter if there has been a permit or not.)

      Since you brought up this topic, how’d you go about it?

      Either way, society is FAR from being anywhere near enlightened enough to deal with this kind of stuff considerately. People’s minds need to undergo a huge revolution towards reason, openness, equality and tolerance. Until then, I think we’re better off not legalizing the stuff.
      Lowering the age of consent by several years, and finally applying the AoC in a coherent manner (if you legally can have sex, you can also take and distribute pictures of it etc.) however are measures that couldn’t only be taken right now, but are long overdue.

There’s cogntive development and while the most progressist say the cognitive development is complete by the age of 10, even the most conservative cognitive researchers said and keep saying that by the age of 14 the cognitive development is complete and the same as that of a 40 years old.

          It comes down to a conflict between nature and society. For some reason society views sex as something exceptionally dangerous, on the level of drugs if not worse in some places. Anyone who has had decent sex ed will know this is bullcrap, spread by religious people who cannot let go of their ‘traditions’

          Fact is, girls can have babies at 12, and have a fully functioning set of genitalia long before that. The same goes for boys. Nature has designed us men to be attracted to girls of and around this age. To brand such people as dangerous criminals and social outcasts and call them ‘pedos’ is to misunderstand the real problem. The problem is the people having sexual activity with children and babies younger than five.

          I sure as hell think that they would understand the risks of sexual activity, if the risks were explained to them, anonymous! The real issue here is that you wish to treat children as slaves and idiots, who don’t know what is best for themselves.

          To be blunt, I was having sex with adults and teenagers at 7, and I damned well, after reading numerous books on the subject (health books) understood the risks.
          I also knew that the risks were NOT as high as people made them out to be.

          It’s time to STOP treating children like they are ‘lesser’ than adults are, and realize that they are MORE than able to understand things that the idiots adults like anonymous above think they are incapable of understanding.

          The real issue here is that they don’t want to give them a chance to prove them wrong because once they do…… children will be given the same rights as adults.

        • The only reason why you think children of a certain age should be given age appropriate choices is because children are never fully educated to the best. I’ve seen some smart 8 year olds that can make really complicated logical and moral choices, then i’ve seen some 8 year olds that can’t turn a doorknob.

          My point being, is that if you keep dumbing down your own child under the pretense of “well he/she isn’t old enough to learn that” your just ill-preparing them for the realworld because by the time you go to talk to them about it, they are in most cases already neck deep in it.

          A child of 10 years should be given choices that are appropriate for their age. Do you really think a child will understand fully the risks involved with sexual situations? At such a young age their mind isn’t mature enough to understand such adult topics and they shouldn’t have to to begin with. Children should be children.           With proper education and giving a sense of responsibility to children, even a 10 year old is able to decide anything for him/herself. Of course if they are told “no need to take responsibility for yourself, just do what others say they know better” they won’t be able to but that will turn them into zombies/idiots/slaves of society in long term instead of responsible adults.
          Do we really want that?
          How many more irresponsible adults do we want before we wake up? Won’t it be too late by then?

      15 is the average age of first sexual intercourse in my country, and 16 is the legal age if there’s parental consent.

      There is not some out of control problem of STD’s or teenage pregnancy, that’s what we have sex ed for. Neither do these people get traumatized. Either the relationship works out or they break up and move on with their lives, no big deal and none of them ever complain.

      But here’s the sad part. Go up across the border to some country with a legal age of 18 and suddenly that same couple gets torn appart, the older partner gets a long time in prison though not nearly long enough according to the common people, the younger partner will go to forced counseling and mysteriously ends up with a trauma, and the newspapers have a field day writing about the horrible “rape” while those 2 related families can live in shame for the rest of their lives. Than what is it really that causes the “psychological scarring”? The sexual relationship or the response of society towards it?

      If we wouldn’t turn normal sexual activity into something almost spiritual and dogmatic, linked to totally unrelated concepts like respect, dignity, virtue,… there wouldn’t have to be so many millions forced into the roles of victim and perpetrator.

In truth by the age of 14, even according to the strictest theories on cognitive development, you have all your marbles and have the same mind of a 40 years old. In fact the psychologist Robert Epstein created a test to determine how mature a person is and and tested many teens and adults and the result of this research is that generally teens are more psychologically mature than adults.

        Isn’t it interesting that the age of maximum cognitive development and psychological maturity is the same on average you’re fully into puberty. Do we need any more evidence that nature knows it better than poor arrogant humans and had already drawn its lines on the sand for us since millennia?

        Adolescence is a social myth, there’s no psychological adolescent just childhood and adulthood and whether you’re a mature adult or not has nothing to do with age but with the kind of person you choose to be. Teens are adults and have the same brain of adults (they actually have more grey matter) But we just have to observe our politicians to understand that having the brain of an adult means nothing, since it is capable of irrational and immature choices too.

        So clearly age can’t be a limiting factor in making such a banal choice as what to do with your body, otherwise even immature 40 years old would be forbidden from making such choices. And the age recognizes that a 14 years old is mature, because while a 6 years old can kill a person withou consequence, a 14 years old is fully responsible for his crimes because he is perfectly capable of making a choice and thinking of its consequences. That’s why 14 years old can be prosecuted and go do juvenile prison.

        And you’re really telling me that at 14 you’re old enough to maike the conscious choice to steal or kill but not old enough to make the conscious choice to have sex or take pictures of yourself naked? This is beyond stupid.

        You should read a book by Mike Males “America’s War on Adolescents”. He quotes dozen of studies that proves that teens are more compotent than adults, not more vulnerable or less mature at all and that treating them like babies that can’t choose about their life is a form of slavery and the worst trauma they can receive not to mention a ridicolous modern norm.

        That’s not true, there are laws that state that if you are over 18 years of age then there is a 3 year difference between people you can sleep with legally, for example an 18 yr old can sleep with a 15 year old and it isn’t illegal. However, a 22 year old can’t sleep with an 18 year old because they are more than 3 years of age, this works until the person reaches 21 where after that anything is open game. I don’t know if this is true for other states, but this is true for Texas.

        To DHYohko. U.S. Law (depending on the state) allows an 18yr old male to have sex with a 16 year old girl. A 19 year old can have sex with a 17 year old girl. You can legally have sex with a girl 2 years younger then you, but no younger.

        No one really cares about the distinction, but it’s only technically pedophilia if the object of sexual desire is prepubescent. Desire or attraction towards a sexually mature youth is not considered an abnormal paraphilia. That being said, acting on such feelings is illegal and suppressed in our society because of the social immaturity of the youth.

        Saying “In the USA…” is usually a bad thing to do when the laws your talking about vary by state. The states vary wildly on the age of sexual consent. But yes, Some states and prosecuters are crazy about that kind of thing(18 yr + 17 yr) in the US. As I say constantly in everyday life “Too many **** lawyers”.

        I mean, We have to warn people that the coffee they just paid for is hot. Really?         No, that’s not US law, that’s certain state laws. There is no national age of consent in the US, it’s all done state by state. At least half the states are 16, a bunch more are 17, and maybe just a quarter are 18.

      • The legal age of consent and the age you need to be in legal pornography is often different. For example, the legal age of consent in Canada is only 14, while the legal age in pornography is 18. This basically you can have sex with a 14 year old, but if you make a video of it or whatnot, you can technically be charged for making child porn. On a side note, CP can be legal in Canada, it’s just that it needs to be pretty much made out of your own imagination, like a journal of your sexual fantasies, and it can’t be shared with anyone else and is kept completely hidden and private.

        If you’re within 5 years in age of each other then you are free from any legal restrictions involving pedophilia/etc.

        Dating itself is harmless. You can date all you want up and down the sidewalk for all the law cares. Sex on the other hand must play into the age of consent guidelines for most teenagers, otherwise it’s statutory rape regardless of the age.

          Pedophiles have been around since the Ancient Greeks, or maybe even earlier. Plus, in non-Western countries, it’s perfectly normal for an adult to have sex with a child. It’s proof of that child’s ascend to adulthood.

          Here in the West, we’ve outlawed it because of religion. And it has given us a warped perspective of pedophilia and adult-child sex. Children have become mindless beings with no sense of sexuality whatsoever and who apparently don’t know themselves well enough to know what they like and don’t like.

          What’s even stranger is that there is no unanimously agreed AOC worldwide. One country sets it at 13, others at 18. Even in the US itself, each state has its own AOC. So, if ‘experts’ can’t agree on when a child truly becomes sexually mature, why do we put so much value into their words whenever they speak bad of adult-child relations, or even the law itself?

          The anon above is partially correct. Though it would be best to describe this situation with the term ephebophilia.

          Pedophilia refers to sexual interest in someone who is prepubescent (as puberty depends person to person there is no all-encompassing age to prescribe). Generally an age of ~11 is used as an average.

          Once pubesent there are 2 terms to prescribe. If a younger (ie 11-14) hebephilia and if older (ie 15-19) ephebophilia.

          Ephebophilia was quite common in the beginning of the last century and before and due to the general ignorance of most people is now considered interchangable with pedophilia.

          The major difference between pedophilia and ephebophilia is that first is a horrible disease and not natural (I’m speaking from a evolutionary standpoint as I am not religious). Ephebophilia is an entirely different condition and quite natural, the people who “have” it are not necessarily sick, in truth all men have some level of ephebophilia since evolutionarily the healthiest babies come from younger mothers.

          Anyhow, that’s my 2 cents and I hope it will satiate some of the misinformation regarding pedophilia.

          bad laws can be put in place and are technically illegal to go ageist, but if you go before a judge and jury its possible to get the law thrown out or to use a different similar case as a deference.

          thats why loli is technically illegal, but no one has ever stood up to the law, opting for a lenient sentence, and guaranteed release instead.

          with age of consent concerned, my friend who was 17 went out with a 16 year old phyco bitch (not making that up) broke up with her, and was scared shitless for the next few years because she could have went after him with a statutory rape charge.

          It’s not like that in italy.
          Age of consent is 14 wich raises to 16 if one of the partner has some kind of authority upon the other (e.g. an educator and his pupil).
          If one of the two partners is below 14yo then there must be a maximum difference of 3ys between them (e.g. 13-16).
          To sum it up here in italy you can freely fuck with a 14yo, but it’s still risky because if he/she reports you to the police you will mostly get accused rape and shit like that.
          14yo is not so low anyway they are not that much loli anymore at that age 🙁
