The ‘pure-love adventure’ game takes place in a traditional school setting, featuring five heroines to pursue, and over 100 unique CG pictures and 15 H-scenes to unlock. The girls are fully voiced, and the game also has an animated opening sequence and various songs.
In a question-and-answer session, Max Factory assured the stunned audience that despite the ‘free’ label, the game will have all trappings of comparable erogames on the market.
Only the limited edition of the game, bundled with a Figma figurine, will retail for ¥2,800.
The release date for the game is March 26, 2010.
The distribution method and any verification of the purchaser’s age with a free distribution have yet to be determined.

Legally free and just "free" are two completely different things, like Darkrockslizer said, this is good advertising, I'm pretty sure they'll also be accepting donations, like some music authors have been doing for a while now.

Looks like they just chose to use real world references for immersion rather than inventing brands. People don't normally do that for fear of legal trouble, but they're unlikely to get sued or anything. Why sue someone that's advertising your stuff for free? :)
A company can take issue over the nature of the content their brands are associated with, is the only problem.
If they have no problem with it, sure, it's free advertising.
it's Japan, where otakus will buy virtually anything else the company sells in the market, especially those with "limited" or "special edition" or "collector items" tag with it (in a bulk even).
the games were free so many people will try, hopefully madly in love with it, and buy anything the company throws at them.
they already starts with figma, and if the popularity can reach the level of Clannad/K-on/Haruhi, fans will buy even the developers urine if it's named, packed and marketed well.
It's my opinion that it depends on what type of characters they have in the game. I'm guessing they have a lot of confidence that the characters will endear themselves to otaku well enough to bring about the scenario you mention.

Not so sure about such a calamity scenario. You can be sure that the other game companies are going to analyze the economic soundness of this new trend that MaxFactory has given birth here. If it works I'm sure there will be more than one "strategic merging" or alliances to to follow (A "TypeSmile" or "Goodmoon" anyone?).
Well, without this freeware campaign it would have been "just another eroge" nobody would even notice. They've got to make it stand out somehow...
