Xbox 360 Kills Baby

The Xbox 360’s gaming excellence has claimed another victim with the news that a man was so compelled to play the console that he accidentally killed his baby daughter through sheer exhaustion.

The 30-year-old unemployed Miami man lived with his partner and two daughters; he apparently took care of the children whilst she worked and studied.

He evidently also had much time for leisure, for after a session of cannabis use with a friend one afternoon he engaged in a marathon Xbox 360 gaming session, which only ended 6AM the following morning with him passing out.

Soon after losing consciousness he was roused by his partner, who had him feed the baby; once he had done so he went to bed with his two infant daughters. Seven hours later he awoke to find himself “lying on top” of his 7-month-old daughter, who had been smothered.

The man is also suspected of moving the baby to its crib in an attempt to avoid arrest.

This was not an effective tactic; police arrested the man for the aggravated manslaughter of a child, with bail set at $75,000, describing his conduct as “irresponsible.”

Just what game he was playing is not clear.

    This actually happens all the time, usually they don't even press charges. The only reason this is at the fore-front of news is because it is both games and drug related. Two key words in mass media. If he wasn't doing pot, this wouldn't even be known.

    Not that long ago a mother killed her newborn sleeping with it. You have to realize that infants when first born are use to being and want to be held 24/7. Many parents accidentally fall asleep with them or lay them to rest in their bed and sleep next to them. Many breast feeding parents often do this because infants like to be coddled and feed constantly, the only chance she has of falling asleep is often at the same time as the child. In fact many books dare suggest attempting to sleep with your child, because the probability of something like this happening is literally in the 1:1,000,000.

    When it does happen however it seems like extreme news. It's just like a donkey you wouldn't expect it to be the deadliest animal in the US would you? It is.

    Of course people who have no kids, have no clue. Yet there eating this shit up.

    I just want to add even the most extreme Marijuana use is not even a sleep inducing drug. However staying up to 6am is the real cause of his deep sleep.

    So ultimately your punishing him for staying up late. Since MANY previous parents have accidentally suffocated their child. Do you prosecute every parent that put their child stomach side down in a crib, when they die of SIDS? What about parents who have to dead with extreme colic babies? Who have to stay up nearly 24 hours straight and end up sleeping with the child?

    You have to ask yourself why is this guy special?

    I really don't like if my sisters or mother sleep in the same bed with infants. This often happens. Maybe there is some parental switch which makes you not to move in your sleep, but I bet if thats the case, stress or other heavy influences on the body like drugs works against it.

    Actually, Co-sleeping is done in many places all over the world and very rarely causes death by smothering. Usually (though I'll admit it's not likely 100%) when smothering does occur it's when the parent is under the influence of drugs or alcohol and are therefore less aware of the child when they sleep.

    It has also been shown that co-sleeping reduces or eliminates the risk of SIDS. The Theory is along the lines of the infant having another human presence there to help it's body regulate it's heart rate and such.

    I could go on about the benefits of contact with infants but I doubt any of you actually care...

    Regardless, this is an unfortunate incident, but not shocking whether the cause was weed or just plain exhaustion.

    Though, I can see bringing up charges for the illegal drug use, assuming he didn't have a prescription...

    [In order for you to find the defendant guilty of aggravated manslaughter, the State is required to prove each of the following elements beyond a reasonable doubt:
    (1) that the defendant caused (insert victim's name) death, and
    (2) that the defendant did so recklessly, and
    (3) that the defendant did so under circumstances manifesting extreme indifference to human life]

    I don't see #2 and #3 here. Being asleep is hardly reckless. Last I checked, everyone needs to sleep.

    If he wasn't drugged up and showing a complete disregard for the welfare of his children then it would be an accident, but this is clearly a case of extreme negligence. His negligence clearly constitutes recklessness and indifference to human life so I think he's guilty.

    What he did was similar to killing someone while drink driving - it's an accident but it's an accident caused by the driver's negligence and recklessness.

    Sleeping in the same bed as infants however is pretty careless, and can quite easily result in the smothering of the child beforehand. He was most likely deemed reckless and indifferent for doing this. This is their #2 and #3

    Unfortunately this kind of stuff happens all the time, the problem here is he's using Marijuana and that government has made people ignorant of it. Cough syrup or allergy medicine is more dangerous in this situation than Marijuana, but do you think someone would get charged as reckless for taking either of those sleep inducing medications? No.

    Also these happen thousands of times every year and almost no one else is charged with it.
