A man accused of abducting and indecently assaulting a young woman has had all charges against him dropped after judges ruled that the mentally handicapped woman was too stupid to accuse him of any crimes.
The 60-year-old man, an unemployed resident of Miyagi prefecture, is alleged to have offered a 20-year-old woman a lift in his car, but after driving off with her he is accused of groping and otherwise molesting her.
Charges of indecent assault and kidnapping were filed against him based on the woman’s testimony.
However, judges ordered all charges be dropped, ruling that as the victim was mentally impaired she was not capable of accusing her supposed assailant of the crimes.
Both crimes required the victim, apparently the only witness in the case, to formally accuse the defendant of his wrongdoing. With the victim ruled incapable of accusing her assailant due to being non compos mentis, the case was dismissed.
It would appear the judges concerned have declared open season on the mentally handicapped, not that prosecuting people for serious crimes based solely on the testimony of the insane or mentally retarded is necessarily a good idea…

That's really fucked up, the raping of a mentally handicapped person as well as the rapist getting off. I personally have an autistic sister (I am assuming the woman doesn't have a SEVERE handicap as she was able to contact authorities.) and I know that if this was to every happen to her I would fight tooth and nail to get the man prosecuted. I did READ. Common knowledge of most countries laws tells you that having sex with a person who have a severe handicap, as the girl did, is rape. True, small traces of evidence can still be found. Yet don't forget that these evidences can also be void due to mentally disabled people being witnesses.
It's the same as a demented guy being released, free of any criminal charge since he's retarded. The most they could ever do to him is put him in a home for the mentally disabled.
The only way for that guy to be charged and jailed is to have at least ONE witness, just ONE, other than that mentally disabled woman to have been present and witnessed the whole thing and stepped forward to testify.

You assume mentally disabled have no sex drive. And as she couldn't accuse the guy or rape, it's not possible to discern if it was volunterly or not.
Even if she says she didn't like it, that doesn't change anything as there's plenty of normal girls who would feel the same after a normal encounter.
