Bandai Namco Shamelessly Lied to Xbox Testers

Bandai Namco has been caught in a rather embarrassingly brazen lie to upset Tales of Vesperia beta testers, adding further to the controversy surrounding Microsoft’s efforts to secure Japanese exclusives for its console.
The Xbox 360 beta version contained a mysterious room in which a girl’s pirate hat could be found in a drawer, “with the barely legible name Pa… written on it.”
When the PS3 version was announced to have pirate loli character Patty Fleur, Xbox 360 testers quickly remembered the room and its incriminating contents.
Confronted some months ago, Namco replied “There is certainly such a scene, but it has no connection whatsoever with Patty.”
Players visiting the room in Perfect Tales of Vesperia were however greeted with this sight:
Yuri: “Hmm… So you were staying at a place like this?”
Though nobody really expects them to come clean about the pile of money they received from Microsoft in order to develop what they secretly planned as a beta version of the full PS3 release, they might at least be expected to exercise more finesse in placating the understandably irate testers…

first of all, what was so illegitimate about their sales methods? packaging more content in a year later version you don't get isn't illegal. if it were than every director's cut would apparently be illegal. You not liking something doesn't make it illegitimate.
second, if losing an exclusive was so easily sue worthy than both MS AND Sony would have a field day making money back from devs.
third, what would MS get from suing the shit out of Namco? MS can't argue harm. they got exactly what they wanted, a bunch of software moved, consoles sold. apparently all within the amounts they expected.
so what would they sue for? also, then what? If the Vesperia saga has shown anything its that japanese devs aren't really expecting much from the 360 and are only dev-ing for it because of MS's "superior support"/"grant". MS starts suing, they can kiss a lot of the japanese devs goodbye as they've just gotten rid of the only reason they're working with MS.
Suing the companies developing for you is totally a good way of getting them to do more work for you in the future, right?

There is no fraud here, Namco Bandai didn't deceive YOU in anyway. They never promised the consumers that there won't ever be another version of the game with more content. So the buyers weren't tricked into buying the 360 version.

It's not actually a beta though. That's a metaphor used to describe the fact that the PS3 version has extra content.
It is in fact a full game. So is the PS3 version. They just happen to differ.
There is absolutely nothing fraudulent going on here, period. You might be able to make an objective claim saying otherwise, but nothing done was illegal.

lol there was no fraud. They never promised the 360 owners any extra characters. Also, if anyone states "the game isn't complete", that's an objective standpoint. They could easily argue that they plan to "unlock" more as dlc later. Therefore, no refunds. You can, however, trade it in for the PS3 version ^_^

It was released on the Gamecue first later on the PS2. The PS2 Version got some additional stuff because it came out later and the devs had more time to add it and were probably afraid nobody would buy the exact same game that came out for another console a year earlier.

Loyalties and betrayals aside, I think the real issue is if there was any breach of contract on behalf of Bandai Namco. There might be major legal issues if there was a contract for ToV to be made exclusively for the 360. Then again, because of such a contract, that might be the reason the PS3 gets an upgraded version instead of a simple port (since it's a different version, it might be considered a different game).
But that's just the opinion of the player. All legal matters will come out in time.

What Microsoft is doing is illegal since they are trying to bribe developers so they can own the market. Doing that is usually considered illegal and immoral. The only reasons why they haven't been prosecuted for it is because they pay people off and because the games usually do come out for other systems in time.

All these high graphic consoles have started to spoil everyone nowadays because "gamers" this generation tend to be nothing but graphic hogs now. I used to remember playing games just for the sheer fun of actually playing though the entire process, despite the fact games used to be low graphics but actual gaming content that could last a minimum of 70 hours to play through and it was still entertaining. Nowadays there are nothing but high graphic cinematics with short 10 hours of gameplay, and people immediately declare it as an amazing "hit". People should really stop caring about graphics and start focusing on the actual fun gameplay aspect again.

This had nothing to do with the fans, brand/system loyalty or anything. There is only one factor in all of this: Money. That's it.
Why did Namco release it to the 360 first? Money. They got money from Microsoft that allowed them to fund the development of the game without digging into their own cash supply.
Why did Namco port it to the PS3? Money. The PS3 easily has a greater ownership rate in Japan than the 360 does - it would be stupid not to capitalize on that.
