Policemen Force Woman to Urinate: “We Didn’t Look”

A woman is accusing male police officers, who held her down and forced her to urinate for them, of a criminal human rights violation.

The woman, in her twenties, was taken into custody after causing a ruckus at her Osaka home. Police then obtained a warrant, and ordered the woman to urinate for them, with three male officers holding her down.

The woman launched a case against the police, alleging their procedure was an illegal violation of her human rights, and saying she “felt terror equivalent to that of rape.”

In their defence, they point out that one woman officer was watching as she was being restrained, and that “we turned away and that was enough.”

Analysis of her urine would demonstrate she was using stimulants at the time of her domestic rampage, with blood and urine samples being sufficient grounds for prosecution under Japan’s absurdly draconian drug laws.

Her counsel asserts that this evidence was obtained illegally, and so cannot form the basis of a prosecution.

    Before you start acting smart and calling others dumb, you should do well to read the article properly and think of all likely scenarios which may have happened at the scene.

    Firstly, there is no mention of the act being performed "on the sidewalk" or in any public places.

    In fact, in the original Japanese article, it is stated that she has been taken into custody, after which the police obtaining a warrant for the forced collection of the urine sample from her. So this is just routine order, and nothing out of line.

    To put the point in, her urine tested positive for stimulants.

    There is also a high possibility that the woman was refusing to cooperate and provide any sort of bodily fluid sample, ignoring the warrant and generally causing problems for the officers who are just performing their duties. When the suspect refuses to cooperate with officers of the law, they can legally use authorised force to ensure their duty is performed.

    But that's in part what the lawsuit is about, whether or not the force they utilized was lawful or not, and if not, then the resulting evidence could be inadmissible, depending exactly on how their legal system deals with material like that.

    Some systems allow for illegally obtained information to be used in a proceeding.

    Example: a burglar breaks in somewhere and discovers a narcotics lab somewhere. He later gets arrested for breaking and entering elsewhere. He could then utilize his knowledge of the whereabouts of the narc lab to get a plea deal. And police could perform a raid upon the location etc etc.

    His testimony would also be allowed in such a system.

    With the higher ups having granted the policemen and woman incharge to perform this act of forced-collection, it has shown that this act is well within the routine protocol of the Japanese police force, meaning it is lawful in the eyes of Japanese law.

    Had the police officers performed this act without the proper warrant nor a female officer at the scene to act as the witness that no unlawful acts were performed, they may have had a case to fight for.

    But with all proof against her, and even her urine has proved that she was on stimulants at that time, this is but a desperate final struggle by the defense for a gone case.

    Here we are talking about civil law enforcement working directly under the law. If the act of gathering evidence in order to enforce this law, is against the same law, then there is no point for law enforcement.

    It's basically just plain old bullshit. She knows it, her lawyer knows it, the police knows it, and the judge (should) know it.

    I can appreciate your idealistic views on this, do wish that more folks thought and acted this way.

    Unfortunately, in the world that we live in, just because law enforcement is doing something, doesn't mean it's legal, even when they're ordered to do so by their brass.

    And this is something you come across even in the "civilized" nations, like Japan, like the US, like in Europe etc.

    There have been plenty of cases over the years, where the police gathered evidence, but done that in a way that made it inadmissible in a court case. The whole concept of someone getting off on a technicality hinges on law enforcement making mistakes during their actions.

    And then there are the cases like the one dealing with the murder of Edward "Teddy" Deegan in 1965, where the FBI allowed for 4 "innocent" men to be convicted for the murder, even though they knew who'd actually been involved (one of those being one of their own informants).

    And then there was COINTELPRO to name another example.

    And yes, I know, these are all US examples, but that's just because I'm more familiar with US history, than with Japanese history. Doesn't change the fact that stuff like this happens everywhere.

    Whether the American government did bad things 40 years ago has no bearing on the guilt of this person. You've read an article that has been convienently translated as so it's missing crucial facts that make the woman look guilty as hell and on the basis of that you claim some sort of conspiracy?
