Japan’s vibrant porn industry is terrified of the draconian nature of the impending loli ban, which not only threatens to ban much 2D material, but also threatens to eviscerate the world of Adult Video with its potentially draconian stipulations.

Porn makers worry that they will be forced to avoid any material featuring girls of marketable age in case they turn out to be underage, and that amateur pornography will be completely illegal as participants will need to all prove their age.

Those pushing the ban also demand any suggestion of a child result in the work being considered child pornography, which could mean any use of a school uniform could result in arrest…

The Diet is currently considering the details of laws which will attempt to criminalise “simple possession” of materials featuring erotic depictions of under-age participants (distribution and production of such material is already strictly banned); 2D material has seemingly won a temporary reprieve, but the AV industry is deeply concerned that it will immediately bear the brunt of the new laws.

AV producers recount tales of being duped into making child pornography by lying minors, who are subsequently feted as victims whilst police prosecute the company:

“There was a case of a 16-year-old girl who stole her sister’s ID in order to appear in a porno, but the one who was arrested was the CEO of the company, for making child porn, with the girl being the ‘victim’. That seems to be fraud to us, but in the eyes of the state she was a ‘child’”.

The problem is made worse by the fact that Japan’s proposed law will consider any material featuring participants below (or possibly merely apparently below) 18 to be “children”, whereas more sensible jurisdictions (though not all) make at least some distinction between 16-year-olds and 12-year-olds.

Ambitious proponents of the ban even seek to have any material “apparently” featuring potential minors banned, which would mean that so much as a whiff of a school uniform would result in criminal sanctions, destroying much of the AV industry overnight.

The issue is so acute that some in the industry lament that “Soon we may only be able to make material featuring MILFs (“jukujo”; attractive mature ladies)”.

Another issue is that amateur productions, and perhaps even the videos of individuals, will have to obtain identification from all participants demonstrating that they are over 18, which in many genres of pornography may prove difficult.

Accidentally including any minors, or perhaps even being accused of including a minor and being unable to identify that person, may result in severe criminal charges.

There is also much concern that merely being sent such material, or seeing it in passing on the Internet, may result in a serious offence, a concern exacerbated by the fact that material which possesses no clear provenance may be freely interpreted as illegal.

It remains to be seen whether Japan’s enormous, hugely profitable and presumably well connected porn industry will be able to mount any opposition to the laws; already AV makers and adult magazines are speaking out against the provisions, a far cry from the pathetically supine response of the otaku industries…
