Wow, considering how well Kyoto Anime is aware of the subculture it creates, in this case it's ripping off its own fanbase. Can you even copy violate a semi-organized, loose group of Otaku(s)? If push comes to shove, how do you even cut split check like that?

Legally speaking, copyright infringement is usually a civil issue, not a criminal issue. That means the law only intervenes if the copyright owner actually complains (this explanation is greatly simplified and not 100% accurate, but it's basically how things work).
In the case of Lucky Star, though, they might as well care since they've seriously gone beyond parody into the realm of profiting off other people's works. They might as well call it Lucky Star: The 24 minute Commercial for Random Otaku-related Products.
If I see Haruhi in Lucky Star one more time..
errr, kyoani made both haruhi and lucky star, so i think they have the rights to show them in anime.
