Much like lolicon, shotacon is one of those thing in the gray area of being legal. The first amendment protects it but some child porn laws says its illegal. It a depends on people in your local court house think.

The supreme court later ruled that part unconstitutional and thus for lolicon alone no. HOWEVER loophole exists where using the concept of obscene and the miller test they CAN get you for about the same. In short loli IS legal but it's offensive nature makes it ILLEGAL, So it's really a twofer. It's both legal and illegal at once thus making it so even the feds can't tell ya whether it is or isn't. So yes it is officially legal but unofficially illegal.

With it falling vulnerable to obscenity laws couldn't the verdict vary depending on the state and/or jury concerned? If so that doesn't seem very reassuring.
