Copyright Law Changes Would Affect Cosplay

    Media artist Kazuhiko Hachiya left a warning that if Japan joins the Trans-Pacific Partnership Agreement (TPP), the resulting changes in the Copyright Law of Japan would affect cosplay, among other derivative works.

    TPP is described as "an Asia-Pacific regional trade agreement currently being negotiated among the United States and eight other partners" (Australia, Brunei, Chile, Malaysia, New Zealand, Peru, Singapore, and Vietnam). The agreement aims to make copyright laws uniform across all the signatory countries.

    Japan is still not included in the signatory countries, but Japanese Prime Minister Yoshihiko Noda will be attending the Asia-Pacific Economic Cooperation summit in Hawaii this weekend and expected announce if they'll join.

    Under the current law, the police and prosecutors cannot act against copyright infringement unless the copyright holders themselves file a formal complaint. But under TPP, such violations will no longer require a complaint for prosecution. The proposed changes under TPP would also allow statutory damages to be levied against defendants.

    Hachiya said that he fears that the police would be given the discretion on what to prosecute, particularly on "erotic" material. He further asserted that even cosplay outfits can been prosecuted if the police decides that they are not allowed.

    Many manga artists, including Akamatsu, creator of Love Hina and Negima. He stated that the changes "would destroy derivative dōjinshi." He added, "And as a result, the power of the entire manga industry would also diminish."

    This is something otakus should rally about, instead of complaining about the virginity of their seiyuus or OWS-type outrages. They have suffered enough from Ishihara and the quake.

    Nothing for me to do about. My country's already signed into this shit, so whatever happens in Japan doesn't matter.

    Also, we might lose hot cosplays, but hey, a lot of childhoods will be saved from the uglies, lol.

    Highly - doubtful - that this will progress further..

    (imo) ~ in theory ~ then this will also reach film studios, affect actors, who (technically) cosplay/costume to represent real people, as well as other characters and individuals.

    This will/would also further effect all types of - re-enactors - as well, as many others...

    You also will/would not have the CON booth-babes, if you want to take it further, as some will probably want...

    Anything represented - "in costume" - would be effected, so very doubtful, that any business would like to lose money for such a representation.

    Then again, this is just my - "personal" - opinion...

    If the booths are from an event that the IP owners themselves approve/join(such as comic-con), shouldn't those booth babes be free of liability? I mean, they must WANT people to go to their booths.

    It seems this TPP fad is still under negotiations. I really hope this shit collapse because people in my country are not even aware of this(hell, I wasn't aware of this until OP posted) even though they should've been informed because this will affect their existing rights.

    Considering the politicians' track record though, my hope is really running thin; once the corporations' lackeys hand over some cash under the desk, it's on.

    Too many people will lose money, and - (worst case scenario) - let's not forget... America's/world's Holiday...Halloween.... that will be affected as well...

  9. It sounds like another shit law made by completely inept morons like ACTA that needs to die.

    Really being that overly protective about IP will only do a media massive harm as it would drive fans away.
    For people that own the IP in question it's biting the hand that feeds you.
    One must be willing to strike a compromise and allow derivative works as that's part of fandom.
    Imagine if Startrek and Starwars fans had to deal with such absurd laws the series would have died out and there would have been no Star trek movies etc and Starwars would not have been nowhere near as hugely grossing of a franchise.

    BTW I used the cleanest and most polite language I possible could.

    not only Star Wars and Star Trek but any franchise that is well known, whether it is videogames, movies, comics, etc. All would have died out after a year or less.
