'Let's Play' videos getting banned

    'Let's Play' videos may soon make you a felon thanks to Senate Bill S.978

    Hold on to your butts, Internet, because this party is going to get a whole lot worse before it gets any better. According to Game Informer, a Senate Bill has been introduced which, if passed, would make streaming unauthorized copyrighted material a felony, resulting in up to 5-years of jail time.

    Bill S.978 states that "10 or more public performances by electronic means, during any 180-day period, of 1 or more copyrighted works" will result in "not more than 5 years" of imprisonment, so long as the performance in question is valued at at-least $2,500 USD, or if the value of a license to legally "perform" the content is valued at $5,000 or more.

    These are, in essence, the same criteria that allow for DMCA take-down notices to be issued by copyright holders, however jail time and felony status are not currently associated with this particular flavor of copyright infringement. Should this bill jump through all the right hoops, its broadly worded contents could potentially cover everything from homemade gameplay clips (commonly referred to "Let's Play" videos), to fan-made music videos, webcam cover songs, and anything else that involves copyrighted music or video. S.978 could also potentially cover cell-phone videos of concerts and press events, making 13-year-old Beliebers and jaded gaming journalists alike equally in danger of losing their right to vote.

    If accepted into law, these addenda will be attached to existing copyright laws and will not only apply to YouTube users, but to the sites that embed YouTube content as well. Internet activism group Demand Progress has set up a web-form for those who disagree with the legislation and wish to communicate their displeasure to their local representatives. We would be concerned about the bill's implications as well, but fear not dear reader: the legislation doesn't cover puppet shows as far as we can tell, so Joystiq Playhouse's shadow-kabuki production of Battle Arena Toshinden should still be on track.

  7. I think if this did get passed the video game companies would be backing up the gamers. This bill is being pushed by the movie industry and record labels who LOVE to sic their lawyers for copyright suits.

    Video game devs, on the other hand encourage gameplay videos. Just look at Halo and Call of Duty, two of the most played franchises allow you to record your gameplay in-game. Bungie allows you to convert it to a sharable format for a few MSP and money hungry Activision will follow suit soon with premium services for MW3.

    Not that I am currently proud of the intents and desires of my own government with their current obsession with a spying bill they are devoted to.

    Jebus fucking Christ, sure glad I have a massive library for when Canada and the US finally figure out how to complete fuck up the worth of even having broadband service.

    If the bullshit doesn't soon end, the internet will become only good for an electronic store front to order stuff from people like Amazon.
    If they kill off the value of having broadband, no one will want it, and thus no one will be able to effectively market it to us.

    I'm sure not paying for broadband for nothing more than browsing Amazon.

  10. My guess is that the video game industry is where the music industry was in the late 1990's. Piracy-reduction efforts will start in earnest soon, but it will backfire and kill the big corporations of the industry in the long term, which I don't see as a bad thing. They may get a few unfortunate teens on this law who can't afford to pay the fines anyway, but the real nerds who are ahead of the curve won't be affected much. It's still a good idea to keep close watch though.

  17. I've been perusing the longplay videos from cubex55 on youtube the last few months.
    some real classics on there.
    would suck if they were taken down...

    Now here's a question, if I, as a swede uploaded some 'let's play' videos, or some AMVs, or whatever... could I potentially be dragged in front of a US court?
    I think not. youtube, however... would probably remove the video without delay.

    here's some things that would also be affected:

    let's say you're playing a game, let's say Metroid Fusion, and you're having a bit of a difficulty with the boss Nightmare, so you go to youtube and search for: "Metroid Fusion Nightmare boss" ... 0 hits. back to gamefaqs you go.

    Imagine you and your warcraft guild has just downed a boss in the latest raid encounter. sorry, can't put that on the web any more.
    even if it's a world-first. you can't upload the evidence, for fear of prosecution.
