Japan Child Porn Ban “Will Destroy Anime & Manga”

Japan’s anime and manga industry is warning that a newly proposed law which has the potential to ban many 2D works as child pornography could devastate the industry and make freedom of expression a thing of the past in Japan.

The new law would constitute Japan’s first national ban on “simple possession” of material deemed to feature minors (although distributing and creating such material has long been banned), with penalties of up to a year in prison and a million yen in fines.

No explicit mention is made of the extent to which the law applies to fictional works, and the general assumption is that it will apply universally even to 2D imagery.

As usual with Japan’s censorship regime, the law barely defines what it will actually be banning, mentioning only “obscene” material featuring participants who “resemble” under-18s, with the determination of what constitutes child pornography thus left entirely to police.

A wide-ranging Internet censorship regime is also mandated by the law, as is a “research group to study the harm caused by manga, anime, games, CGI and other material resembling child pornography to the rights of children” – the latter proposal being a particular red flag to anyone who might have otherwise thought they would stop at 3D.

The law’s sponsors are the usual suspects – the newly resurgent ruling Liberal Democratic party (Abe is known as a personal friend of no less than Agnes Chan herself), enthusiastic whoremonger Hashimoto and geriatric sex novelist Ishihara’s stooges in the Japan Restoration Party, and the Koumeito, the political arm of the Soka Gakkai cult.

Among the most vocal opponents of the law has been “Your Party” (Minna no Tou – a libertarian LDP splinter party which recently annoyed rightists by disowning an alliance with Hashimoto over his unhealthy obsession with comfort women) diet member Taro Yamada, who explains why he thinks the law is an awful idea:

The present law restricts pornography featuring real children. By extension, there is no ban on fictional children. This amendment has the potential to be applied to fictional children.

The original intent of this law was to prevent child abuse. But with these amendments, who does it protect? Children in manga do not exist, are not victims, and so of course cannot be protected.

This law will likely only promote the decline of manga – similar laws in Korea have had a highly adverse affect on their manga culture.

Consider the case of that scene with Shizuka-chan bathing. It is said that it will not be covered by the law. But how far the new amendment can be taken is not stipulated, so creators will be afraid to even draw a scene like it in case they are prosecuted.

Additionally, the people who will judge whether the Shizuka-chan scene constitutes child pornography and then arrest its creators are essentially police and prosecutors.

You’ll never know if they are planning to arrest you, and the criteria for what they consider child pornography are vague and ambiguous, so you can hardly continue to freely create under these conditions.

Of course, there are those who are uncomfortable with the sexual representations of minors which do exist in manga and so on at present – but under existing laws obscenity prosecutions are made, and a more extreme crackdown is hardly required.

Just banning things you find disagreeable is no different to banning natto because you don’t like that taste. I don’t like natto but I don’t want to ban it, just not eating it is fine. People need to understand it is the same issue as with banning TV dramas featuring nasty murders.

Finally, at today’s explanation of this law, its promoter conceded to me that the law’s intent was to protect real children, but that there is no demonstrable link between pornographic manga and the like and actual crime.

His latest update explains there is still hope that the bill will fail:

The future passage of this law is not clear, but this is likely:

1. It will pass in deliberations of the lower house’s Committee on Judicial Affairs

2. It will pass in deliberations of the lower house’s regular session

3. It may be rejected in deliberations of the upper house’s Committee on Judicial Affairs

4. It will then be subject to deliberation in the upper house’s regular session

The main points being:

•The Committee on Judicial Affairs has a lot of cabinet proposals to deliberate on, so it may not get through them this session. However, in the lower house there is only one bill left, so it may get past into regular deliberation.

•The opposition is strong in the upper house, the bill may not even get to the deliberation phase before they run out of time.

•If this happens, it will become just another abandoned bill.

According to my information, voluntary restrictions are already being put in place:

•Manga illustration guides have been dropped from search engines

•A large auction site [Yahoo! Auctions] has even banned auctions featuring pictures of school uniforms, child clothing, randosel [In fact Yahoo has gone so far as to ban even titles alluding to such content...]

•A major search engine has stated that if the law passes they will have no choice but to ban a great many pictures of manga and actual children

•The latest edition of Dragon Ball has cut scenes featuring bloomers cut

With simple possession applied to manga and anime we’re entering scary territory, with wide-ranging restrictions on freedom of expression. I am firmly of the opinion this infringes on constitutionally guaranteed freedom of expression. Your Party and other opposition parties intend to strengthen our opposition to this law over the coming days, I’ll keep you informed.

We’ll fight on with you to the last.

The ill-advisedly named “Japan Cartoonists Association” (in Japanese their name is the more credible “Japan Mangaka Association”), one of the few NPOs the industry operates in defence of its interests, has also issued a lengthy statement condemning the law.

They condemn the law’s application to 2D works as “tantamount to book burning” and not only a violation of freedom of expression but also the reader’s “freedom of knowledge,” and warn it will damage the industry and is more than a little reminiscent of Japan’s pre-war censorship regime.

JAniCA, the Japan Magazine Publishers Association, Japan Book Publishers Association and Comiket’s organisers have all also joined in condemning the law.

The online reaction is no less scathing:

“First 3D, then on to 2D?”

“I get why there is a ban on 3D as there has to be a real minor involved, but the reasons for 2D bans are just incomprehensible… if fiction is out, why is text OK and not pictures? A drawn version of the Genjimonogatari is a crime, but the original text is a cultural treasure?”

“Expect it to get through unless there is a lot more outrage.”

“With the Internet filtering they’ll finally get to create the basis for a China-style Internet the police and LDP are desperate for.”

“At least be sensible and make the definition only apply to depictions of those under 13. A 2D ban on pictures of 17-year-olds is going to wreck the industry.”

“Mangaka comparing this to book burning is absurd. This filth isn’t worth burning. Mangaka have no education so I suppose they can only make such pathetically extreme arguments.”

“Anything featuring a school uniform will now get you arrested by the looks of it.”

“They never include any actual objective standards in these laws! Who do they expect to determine what is out?”

“They don’t need any standards, police will just lock up anyone who has been annoying them for points.”

“One of the real intentions of this law is to let police charge anyone the want when they execute a search – if they find any porn they will be able to claim it looks like child pornography and charge you.”

“They can easily claim most 18-year-olds in legitimate AVs look like minors and arrest you for possession.”

“More power to the authorities just means more abuse.”

“Most Osamu Tezuka works will be caught up in this.”

“The latest editions are already terribly censored.”

“And as usual they are going to leave the junior idol industry alone…”

“At least ban AKB as well.”

“I don’t think they thought this through – the government has been promoting AKB itself…”

“I can’t see most gravure albums surviving this law.”

“The net-right have really been digging their own graves by supporting the crazies in the LDP…”

“Even whilst pushing this ban the government is still trying to promote anime and manga through ‘Cool Japan’ – I hope the creators stop cooperating.”

“It’s going to ban pretty much everything from AKB and Johnnys to Evangelion and Sailor Moon, and since it only has to ‘resemble’ a minor there is no way out for 2D works even if they make all their characters 20-year-olds.     You realize, of course, that a prime minister isn't elected by the people, but rather by the parliament (in Japan's case, the Diet, and then "ratified" by the Emperor). The best anyone can do is make sure their favorite candidate is:

    a) elected to the Diet for their region,

    b) try to rally and get that party in majority control of the Diet (in which case, that party can elect a new prime minister), and

    c) speak out in favor of said person so that they will be the one elected by the party.

    But we have the moral knight nut-cases who think IP's and creations of authors suddenly belong to them, and because they 'look' a certain way the artist designed them, then they are essentially real people. Of course forgetting that the artist made and created the character, and also forgetting the character is a IP and not a person. But just because it looks 'human' it must be, a real human! Though clearly a cartoon.

    The morally offended dictatorship of this century needs to be fully kicked in it's ass and escorted out. No one real person is hurt or killed in the creation of a fictional story with fictional characters. We should read what we want, and write fiction we want without moral-whiners restricting everything for their own little self-serving egos of control.

    Banning anime and manga does 0, yes I mean absolutely 0 to do a difference any real person. All it does it make it difficult and legally prosecutable to enjoy fiction and punish readers, writers and artist. That's all these blatant laws serve, but they hide under "cp” as justification to draw sympathy and line up the pockets of the dudes who make money off people's sympathy and their stupidity in the mix.

    So they are talking yardsticks now. There are probably some that could circumvent the entire thing if it ever comes into fruition, even if it requires taking a level in ridiculousness.

    Consider the idea of putting wings, tails, kemonomimi or other not-too-distasteful stuff on minor characters. They wouldn't be human anymore and wouldn't ever have to be anyone's children.

    You know a few years back I would have been fighting tooth and nail against this bill but honestly now I just don't give a fuck. With the state that anime is in now being little more than a fanservice ecchi money maker it's not even worth saving that part of the industry anymore. People have turned that simple concept into a perverse way to ring money out of us idiots. The last time an anime moved me to tears was years ago but now i just try to not fall asleep with all the school girls being moe.

    I would try to look on the bright side and think maybe this will put the industry back on the right track. Maybe with them actually producing anime with a masterful story instead of loli panty shots and stories about school girls doing absolutely fucking nothing.

    Such a "concession" undermines the entire argument against the bill. For if it's okay to ban drawings of under-13s, then why *not* ban all under-18? Drawing a line anywhere shifts the argument to where the line should be, instead of whether there should be a line at all.

    No, they need to stick to their guns -- drawings aren't real. It doesn't matter what drawings depict; they should remain protected.

    No, there isn't. Numerous child psychologists have shown that unless children are told that it is 'naughty' and 'nasty', children masturbate from pretty much birth.

    The bottom line is that children and adults are SUPPOSED to be having sex together, nature rules in this instance and shows that by not having force-fields between the genitals of adults and children.

    The 'age of consent' is a made-up thing, meant to justify treating children as 'lesser' than adults.

    You understand that sexually active females are at risk of getting pregnant every time they have sex, right? There's always a percentage that they will get pregnant. Now, do you seriously want to subject girls under 18 to more chances of pregnancy than they already have? Especialy girls under 14?? If a girl gets pregnant before 18 her life is pretty much guaranteed to be over in today's society, for completely logical reasons. This is the fundamental reason for the age of consent. It's bad enough that teens are already having sex with other teens, any more freedoms to allow and accept them having sex, and we'd see teenage pregnancies soar.

    err...that's not the point. "age of consent" refers to if someone is mature enough emotionally to make smart decision regarding sexual relationships.

    what someone is capable of is not the same as what someone should do. as it is, there are physical risks to sexual activity at a young age.

    also, nature encourages early breeding because nature assumes high mortality rates. humans don't die enough to be listening to nature
