I think you’re ignoring all of the variabilities. For one, as it was said and sourced, the driver in question was forced to take a second shift on top of an already long shift; in addition to that, the poor conditions of the road and especially the flawed design of the wall are in inherit question.

It’s entirely possible this was the companies fault for forcing a second shift on the man who, in addition to having a long shift already, was likely horrendously tired. This isn’t America, where you can take naps inbetween vehicular drives; it was his last shift of the day, and he was tired as all hell by that point, to the degree that his eyes were likely pratically shutting down on their own.

The driver may not be as much at fault as you think. I’m not saying he is entirely blameless — indeed, he may not be — but for now, all sources indicate the company is the one’s at fault.
