No – she had passwords and access to the site in the first place. She did the work on the site and as it was stated, maintained it.

It’s like saying “man charged for grand theft for taking [his] computer when he moved away from home. His parents were not at home at the time the thief stole the system.”

Now, if she’d bypassed security protocols through ‘alternate’ means – THAT would have hacking (or scripting, depending on the methods, of course) and it would become cracking (CRiminal hACKING) once she’d bypassed security through alternate means AND done the damage she did.
