K-ON! TV broadcaster Tokyo Broadcasting System has deleted videos of Sega’s upcoming K-ON! game on the grounds of copyright infringement.
The preview videos were deleted at the request of TBS, with YouTube giving the standard copyright response. Sega of course had every right to upload the videos as they were of its officially licensed game.
TBS for its part is not even the copyright holder for K-ON!, being a mere TV station.
The videos were later restored, in what must have been a rather embarrassing incident for those responsible.
The incident of course highlights the fact that apparently neither YouTube nor TBS take any notice of what it is they are actually deleting – it would not have taken a great deal of scrutiny on the part of YouTube to release the claim was baseless.
This has happened many times on youtube, even the European and U.S. youtube had content deleted by requests from people who were not copyright holders. It goes to show you how inattentive the staff at youtube is.
This is why the DMCA is broken. The penalties for false DMCA claims should be extremely harsh. Tons of legit videos have been removed by YouTube without any research into if the claim is even real.
Of course, Google owns YouTube and they hate freedom of speech and the internet, so I guess it’s not surprise.
Maybe SEGA is afraid that if people watch videos about the game they wont buy it.

I feel sorry for youtube. They have to comply immediately with any claim straight away no matter what. In the Viacom lawsuit case it was discovered that they had been uploading videos (for viral marketing or other purposes)on the one hand then making copyright claims on the other. Good thing the judge found in YT’s favor.
TBS is also taking off music covers from youtube due to similar, eg. tkmdr’s (Senri-han’s) keionbu drum covers.

First question should actually be, is this TBS in the first place who made the claims?
YouTube doesn’t verify in any way if you are indeed who you say you are, and will just delete a video if a DMCA claim is filed, scared a sue-happy company (like Viacom) will take them to court for hosting copyrighted material.
It’s possible (or even very likely) that this was just the work of some clown who doesn’t like K-ON!, Sega, or maybe even both and filed a DMCA claim in TBS’ name to show that.
i blame the company in this case. youtube is kinda busy filtering content from the biebertards in the states.

Well, we have known this for years, that the DMCA things are NOT scrutinized properly by a LIVING BREATHING PERSON and that things are removed when they are allowed by fair use or even when the OWNER of the copyrighted thing in question uploads them!
They need to fix this so that companies are encouraged to be SKEPTICAL of copyright claims by someone, until proven beyond a shadow of a doubt.

Youtube, by law, CANNOT check what they’re deleting. If they receive valid DMCA notice, they have to oblige, no matter what.
The funny part is, there are some very serious judical penalties (5 years in prison) for abusing DMCA notices, aka. sending notices for stuff you don’t own.
So not only you can get your videos restored (possibly with recompensation), but you can send those fuckers to prison for sending invalid DMCA notices. That is, if you live in US. If come from more sane parts of the world, you’re totally fucked, since you don’t ave representation under US law.
Guess again! Youtube can ignore a DMCA notice if they realize that:
1. The person in question is trying to have something taken down that another person has the right from the copyright owner to post.
2. The person in question is NOT the actual copyright owner.
Both these things applied here, so Youtube could have ignored the DMCA notices. Hell, I’ve ignored them more times than I can count on my website, because everything I post falls under FAIR USE!
Either as part of an article on a game/movie/music to show why I like or dislike the thing in question, or because it is fanart, which is allowed by Fair Use.

yeah, youtube’s dmca policy stuff is pure garbage. TBS banned my old account because i tagged a couple of my videos as “clannad”, despite only using a couple seconds of footage from the show in each video, i think they’re pretty trigger happy.
I’ve seen a lot of vids that covers songs which has also been removed by TBS. Cover songs.
If you’re absolutely sure you were within Fair Use, then appeal it. Youtube would reinstate your videos even faster than they ‘removed’ them (it pretty much happens automatically now and is in effect until DMCA issuer files counter-counter-notice).
And put the case into to court against TBS to give them some real extra pain.

Well, I’m sure some entry-level worker at TBS was doing this job of looking out for K-On copyright that appears to come from there television broadcast. Either mistakes happen or he/she didn’t really care and just did a search all, tag’em copyright and went to lunch.
I’m sure SEGA sent them letter letting them know who buys ads on there airwaves and how easy that can be removed too.

There are examples of peoples video blogs being removed, that is, just them sitting there talking in front of the camera. And that’s mostly just some moron that didn’t like what they said and reports it for violating their copyright to get rid of it. Youtube staff check nothing, ever.

There’s no way they’ll check every allegation of copyright infringement or whatever. They will just start ignoring requests to take down big companies’ videos. Those uploaded by normal users will still be deleted right away.
We could start to report videos uploaded by big companies, especially those who like to report videos. That would give them some of their own medicine and when they complain it might very well lead to the tube checking what it is they delete.

DMCA if proven wrong can mean a law suit. as its a LAW. and one you can be held acountable for REGARDLESS of you actions or reasons.

YouTube pretty much has to comply, although they do make it easy to file a counterclaim.
IIRC Sega could sue TBS under DMCA for a bad-faith takedown. But as licensee, that would be kind of self-defeating.
Actually, the DMCA says NOTHING about taking down work just because someone sends out a notice. If the notice is vague enough (and most DMCA notices are that are sent to Youtube) Youtube can send a request for ‘more information’ before taking something down.

That’s actually incorrect. It is up to the provider to determine if the claim is correct and remove the infringing content. If they fail to do so, they can be held liable in a later lawsuit if the content was obviously infringing. That last stipulation means most providers will take down anything without even looking at it so that there is no way for them to be held liable, ala YouTube.
Also, there is NO punishment for somebody that files a false claim, except the general false claim of facts and/or damages caused by the false claim. Those claims must be brought up by the damaged party or parties (or representatives of each). This means pretty much it almost never happens as it’s painful and sometimes costly to deal with the litigation.
Can’t blame the mods, really. I guess they receive so many of those messages right now that they just prefer to take them down right away, that’s all.
However I do think that there should be some countermeasures for false copyright reports that would keep griefers at bay.
Actually, I do believe that the laws are at fault here. IANAL but as far as I understand, the DMCA requires work to be taken down without questioning it, and if the request is wrong then the author can protest it, and the person who filed the request is in deep shit.

But if they increase the people working on youtube then the people already working there won’t get as much money, that’s not going to happen.
