Lolita Sex Soldier Spared: “She Was Dangerous”

A 41-year-old soldier who had a sexual relationship with a 13-year-old girl has been spared jail, with the judge blaming the girl for being “precocious,” saying “she made most of the running.”

The 41-year-old veteran, stationed at Sandhurst Military Academy and said to have remained a private for 22 years due to a lack of competence, became acquainted with a 13-year-old girl at the stables where he worked.

The “troubled” girl confided in the man over a period of several weeks, and the pair became friends.

After getting caught drinking alcohol at school, the girl was sent home and subsequently paid a tearful visit to the stables, where she sought comfort with the private, and then accompanied him back to his room at the academy.

She provided a condom and the pair had sex.

The private was subsequently arrested after the girl produced the condom she had kept from the encounter, apparently as a trophy.

The defence claimed the girl was a “sexual time-bomb”:

“She confided in [the defendant]. He would talk to her about her problems and over a two week period they got to know one another.

She was crying and he invited her back to his room to comfort her and one thing led to another. She was a time-bomb waiting to go off. Unfortunately it was the defendant she went off on.”

The soldier pleaded guilty to one count of sexual activity with a child; the judge gave him a suspended one-year prison sentence, along with a ban on teaching any girls under 16.

The judge was uncharacteristically reasonable in her verdict:

“It was clear from the evidence that she was a disturbed girl, that her behaviour was precocious in several respects, that she looked and acted older than her age and she made most of the running.

Whether you knew her age or not, you had the duty as a man in his 40s to make sure she was the legal age.”

The judge went on to concede that being stupid was a good defence for having sex with children:

“She was just short of 14. There are many girls of 14 in this country who are sexually active – this may not be a good thing but it is a fact that has to be recognised.

This was not a breach of trust situation. Although she was vulnerable, you too in a sense, are vulnerable as you are a simple man. What occurred was stupidity rather than malice.”

    The man was at fault since he shouldn't have let things go that far (he was the adult in that relationship with the girl before it turned sexual, after all), but the girl was also at fault... just in a different way.

    But it's very dangerous to call a male judge sexist if you stand for anything.Their decision is final no matter what.And if you belong to any group and say anything to a judge,like i heard from one guy calling a judge sexist and not doing the right decision to a judge.That judge can suspend you from your work for some time,punish you.I think the guy who complained wrote an article about it and the judge forbid him to write any articles about this matter.
    Judges can make decisions with authorithy no one else could ever have.

    Consensual sex shouldn't be a crime but when someone is for example drunk or mentally unstable you're taking a risk whether they still like what happened when they sober up or become better. I don't think it's fair to just take that risk when the other party is in such a state and hope for the best. For children of that age(13) whose mind is far from matured you're taking the same risk. I've seen a story about a woman who had sex with an adult man when she was still a kid and very much regrets it. The fact remains you can far more easily overpower a child mentally/emotionally as an adult.

    Being drunk or clearly mentally handicap is not consensual.

    It is not the government's job to protect our kids. It's ours as parents; and if parents fuck up and don't tell them the facts, responsibilities, and consequences of sex, then it is their fault.

    We are rewarding bad parenting and ignorance in general, which will only spiral out of control.

    I've told my girl that they should never do anything they are uncomfortable with, should use a condom properly if she does choose to have sex, to beware of predators online and off, and to most importantly think carefully about who she wants to give her body to. That sex is between two people that really love each other, and I'd hope she'd share her feelings so I could help her make better decisions.

    We're very close. She's only 10, but because I was honest and open with her, and we sat down and talked, she was mature enough to understand I cared and loved her enough to tell her the truth. I believe she knows that she should trust her father.

    I wanted to be pre-emptive before possible mistakes happen. Good communication is extremely important, and if their parents are off at the bar or in front of a TV, they are going to resent them.

    As a libertarian, all I can do is spread common sense.

    Finally, a case with a very reasonable judge willing to assess this case from various angles.

    From what I can see here is that both parties are to blame, and I agree wholeheartedly that the man should be responsible for his actions in making sure she is of the legal age, although I still do not condone sex out of wedlock anyway.

    The girl of course needs to receive counselling and psychological attention as soon as possible. It is a troubling trend of younger teenagers getting more and more precocious each year, especially with the existence of the uncensored internet, and at least this judge acknowledges it.

    In some rare instances it is not just the man to blame, but it is also on the part of the girl's parents as well, for not keeping her under control. Because of this case, we can't live in denial that teens can't be precocious. That is why we now have to approach this new issue with tact. The culture is changing, now we just have to focus on keeping these men from engaging in illegal sex, as well as keeping these teens under strict guidance.

    Okay, respect for the judge for not putting all the blame on the older person, but to be honest, I think this is one of those cases where it's painfully clear to me why legally the blame is most often put on the adult, mainly the abuse of the innocence or ignorance (I'm not sure if it's the correct word, English is not my native language) of minors.     13 is not a child and at that age people is able to do a rational thinking unless is retard, or got a lame education which seems to be the case. The girl is alcoholic, premature and is not the first time she go behind older men and probably not the first time she have sex with one. Also, girls develop fast and she probably look older. I got my boobs at 9 and hips/waist looks exactly the same that when I was 12, I even have the same heigh.

    I can't believe any military would keep someone stupid enough to stay a private for 20+ years (that's long enough to get to Sargent Major...) on the payroll. In fact I can't even believe someone that incompetent could pass military entrance exams to begin with.

    Not so much stupidity as obvious mental retardation, which is considered as "reduced capacity" in law. It's not so much a defense in and of itself, but it does mean that certain legal tests would necessarily fail. For example, a person with sufficiently reduced capacity cannot give legal consent, can not determine the difference between right and wrong, and a slew of other things. In this case, the judge ruled that, due to his diminished capacity, he really had no idea what he was doing, so he couldn't really be liable for it, at least not completely.
