Equality Now Demands UN Hentai Ban

maria-sama-bondage-mania.jpg

Feminist crusader group Equality Now’s latest moralist histrionics take the form of a strongly worded letter to the UN accusing Japan of being rape heaven, and demanding a ban on hentai and other forms of pornography “harmful to women.”

The letter tells the UN’s feminist arm CEDAW, the Convention on the Elimination of all Forms of Discrimination against Women, to tell Japan in no uncertain terms that it is a bad country which is oppressing women, and there are a number of laws it must enact in order to appease American feminists.

Here is the summary of their rather lengthy screed, which can be read in full here (PDF version):

Japan is a nation which accepts hentai. This encourages rape so hentai must be banned.

Japan is nation where courts let rapists go free with a slap on the wrist. Sentences must be increased.

Japanese judges violate the rights of women by taking into account whether they resisted their “rape.” Women should not have to resist sex to be able to call it rape.

Evil misogynists have waged a “hate mail” campaign against us. We were sent some AV which we thought was child porn involving “girl-children”, but Japanese police experts on pubic hair told us it wasn’t, so they must all be misogynists.

Rapelay was withdrawn from sale, the EOCS banned all fetishes, and some companies have banned foreigners from their websites. This is not enough. The Japanese government must ban everything we object to and make it all illegal.

The UN must tell the Japanese to do as we direct.

It is no wonder this group has attracted “unprecedented” criticism for its unremitting attacks on freedom of speech.

You can convey your thoughts on their wanton attacks on visual culture on their website.

Perhaps being bombarded with criticism in the same way they bombard politicians in other countries with unsolicited mail is a new experience for them, hence their displeasure.

Because most of them could be unreported. Social stigma gets put on the unmarried girl because she becomes "dirty" and the parents have more of an incentive to hide the event rather than to report it.

We need to keep up with the hate mail to EN, but also we need to send some well written mails to the Japanese politicians to show our support for freedom of expression. Don't make this just an eroge issue.

Uhh what? Isn't that to make sure it really was rape?If I had sex with a prostitute and then she reports me for having sex/rape with her,I'm basically fucked, assuming prostitution was legal at that time.

Wat do yur think of dis?

    Dear Sir/Madam,

I refer to your organization’s recent letter by Ms. Jacqueline Hunt to CEDAW with regards to the Eroge/Hentai industry in Japan.

I understand that Equality Now aspires to eliminate all forms of gender discrimination and abuse especially in third-world countries where women are resigned to the most dismal and marginalized roles in society; it is an act that I am personally supportive of. Your relentless efforts are applaudable.

Nevertheless, on the basis of pragmatic reasons, I must suggest that your group stop its movement to pressurize the Japanese eroge industry.

Allow me to point out some inconsistencies in the letter.

Firstly, the hentai games in mention, such as RapeLay, do not perpetuate gender stereotypes. The portrayal of women as being in a submissive position in the game is not reflective of the Japanese male populace’s intentions of subjugating or compromising women. This takes instead from the genre BDSM, short for bondage, domination and sado-masochism. It is a widely found genre worldwide and has never been perceived by anyone to be an act of discrimination as much as it is a deviant sexual fetish. There is no evidence proving that the said genre promotes violence towards women and women only. As a matter of fact, as much as there are pornographic elements that portray abused females, there are a proportionate number of materials in Japan or in the hentai industry in general that have “dominatrixes”, basically the female equivalent of the rapist in RapeLay as well as males who are subject to the same treatment. This is above all, proof of the gender-indiscriminate nature of hentai/eroge and it is acknowledged publicly in Japanese society that these are fantasies that remain fantasies, fantasies that all are entitled to, regardless of gender. While there is indeed much left to be desired regarding this aspect of human sexuality, I believe it is not fruitful nor is it reasonable for Equality Now to attack the eroge industry based on this claim.

Secondly, with regards to the other themes subscribed to in the games, such as that of “incest and sexual abuse of schoolgirls”, these are universal themes that are found not only in eroge/hentai but also in pornography worldwide. For the majority of people who view pornography, this is a variation of sexual excitement, akin to a change of dressing over the same salad. The change in setting or perhaps position is more often than not, simply decorative. For instance, the school uniform is usually not expressive of the desire to bed a young girl. It is however indicative of man’s favoring youth and passion. The ultimate goal is not to derive pleasure from harming women, but just simple sexual gratification.

That said, admittedly there are perverted individuals who perceive it otherwise. However, it is never by eroge or hentai that perverts are born; these depraved individuals are inherently problematic or socially deprived and it is with this pre-requisite that they later seek refuge in either self-delusion or pornography. Eroge/hentai does not participate in the causal relationship between perversion and violence towards women. By no means, is it ever intended to or does it increase discrimination towards women.

In addition, I would like to clarify that the specific genre, lolicon is technically considered to be a part of the kawaii subculture of Japan than it is that of pornography (kawaii-cuteness). Any portrayal of abuse of young girls is a spillover of a liking for cuteness into the realm of sexuality. To be just, lolicon should be discussed in a separate context.

Then, it must be mentioned that the description of Japan’s situation as proof of the perpetuation of stereotypes is grossly misinterpreted, if not deliberately manipulated for effect. This is the faultiest paragraph of the letter. The “great impact on gender stereotypes” conceded by the Japanese authorities a case of cultural stereotypes as seen from beyond the country, as opposed to societal stereotypes amongst the Japanese. Traditionally, women in the media are demure and caring homemakers and thus the epitome of the Japanese lady that figures in any work of art or literature; take for example, the romantic Xu Zhimo’s “Sayonara”. It is thus a common conception by foreigners that the Japanese, their culture and their values are so and such. This cultural stereotype however is only on theoretical planes. With the exception of older generations, still not free of shibboleths of oriental tradition, actual modern day Japanese women are not expected to live up to these “qualifications”, nor will they be chastised or ostracized for betraying the cultural stereotype. Today, Japanese men and society recognizes the difference and respects female rights, proof of which is in the many woman friendly measures the formerly chauvinist nation implements to protect women. It is thus implausible for the stereotypes to be to the detriment of women anywhere, even fictional female characters.

“It was noted that in prosecuting the crime of rape, judges in Japan required victims to give proof that they had fiercely resisted and had been severely intimidated, and also that judges evaluated the victim’s “virtue”.” There is no link whatsoever between this phenomenon and the “myths surrounding rape”. The rationale behind this bizarre judicial process lay not in the widespread Japanese misunderstanding that girls enjoy rape, which in any case is non-existent even after years since the first eroge was published. In reality, it is the conservative and hesitant culture of the Japanese judicial system that resulted in this; the courts of Japan has a tendency of showing leniency to suspects of absolutely any crime unless his guilt has been ascertained beyond doubt. With reference to the statement, “The Committee also expressed concern that the penalty for rape was relatively lenient in Japan”, it must be pointed out rape and molestation is some of the hardest crimes to establish legally, as opposed to robbery or manslaughter which leaves little room for doubt. To make things worse, the legislature of Japan is still undecided on issues such as marital rape and implied consent. This is most unfortunate of course, but it must be understood that it was born of a flaw in the Japanese judicial system and is unrelated to the topic in question.

Also, the games in mention have a cathartic effect on males, especially potential sex criminals. Libidinal impulses inherent in males dictate that they must find an outlet to relieve themselves of their drive. The do this either through a leading a healthy sexual lifestyles, Freudian sublimation or through the use of sexual materials. Regrettably there are people incapable of the first two approaches. As opposed to venting their vagaries on actual living persons, it is for the greater good that they are granted access to pornography. If scientific proof is required, CASPER, a neutral organization based in Kyoto has published its report. It states that areas with ready access to a diversity of pornography have considerably lesser rates of sex crime. If juxtaposition is required, the obvious example of the nation of Saudi Arabia, which has a total ban on pornography and Kenya where your group should be very familiar with can be considered. The statistics do not support the claim that hentai/eroge compromise women. The statistics however, favor the claim that hentai/eroge dams up libido and protects women instead.

Nonetheless, I agree wholeheartedly with Equality Now’s stance on the actual gang rape videos and I am equally appalled by the cruel methods the perverts have used to protest. I believe this is the physical manifestation of my worst fears. All the more do I believe now that there is a real need to stop all action against hentai/eroge.

To conclude, I am primarily worried that should the case against hentai/eroge be heeded, the modern female’s standing might be compromised, exacerbating gender discrimination in Japan. It has been proven that ready access to extreme pornography does not contribute to the “prevalence of violence against women”. What your group is trying to do now, runs the risk of disturbing the equilibrium and unleashing chaos in Japan.

    Jonathan Mitsuoka

Hentai ban... hmm can't say I didn't see this coming. -_-

"Japan is a nation which accepts hentai."

So you're telling me that [place name of nation here] doesn't accept pornography in any manner and in any form of expression? And that said nation codemns it in everyway they can, is that it?

"Japanese judges violate the rights of women by taking into account whether they resisted their “rape.” Women should not have to resist sex to be able to call it rape."

This is just plain hard core discrimination. The male population is at a disadvantage because this law doesn't just apply to women but men to. If the female population are to be exempted from this law, then I can safely say that any act of sex will be considered rape. Also to begin with, this law is already disadvantageous to men since aside from just resisting rape, if the male victim is said to have achieve at least an erection, then it would no longer be considered rape anymore.

"The UN must tell the Japanese to do as we direct."

Who are you to the world and who are you to the Japanese people to say that. Again this is just plain hard core discrimination. To involve themselves into such topics which oppresses the country's morale and freedom of speech, this is act is a serious form of terrorism.

The acts and claims of Equality Now is just down right discriminating to the very core. If the UN and Japanese government are to succumbed to their wishes, then the UN and Japanese government are supportive of communism, tyranny and terrorism. Thus further trusting the security and well being of every country in the world in the UN's hands, should be nullified because it is they themselve who support communism, tyranny and terrorism, even if we are to say it is in lowest form.

If Equality Now truly wants equality, then the same set of laws that apply to men should be applied to women and vice versa. No more exemptions because of gender issues. Else the name Equality Now is just a facade to what should have been called Feminazi Now.

Furthermore, Equality Now should first prove their claims for "equality now" before ever attempting to tackle any more moral issues in one country.

Lastly. Japan should strike back since Equality Now's just cleary being discriminating ever since the beginning. Their claims hold no ground and they can't provide proper evidence.

Calling Japan awful because of drawn photos of people making love while you let your kids watch videos that pretty much say girls are into random sex.

Just like Japan walked out of the League of Nations in the 1930's it might be time for them to walk out of the UN and tell the UN they have 48 hours to remove all personnel and equipment from the country and refuse re-entry of any UN people/groups in the future.

Since Japan is the second highest source of UN operating expenses, it would hurt them in the hardest way.

But modern Japanese politicians don't even have a tenth of the spine that their predecessors had 60-70 years ago, so they will probably bend over and let the UN have their way with them. Just like in a cheap Yaoi story. Which, incidentally, will not be banned because there are no fake women involved and thus the femanazi's could care less.

Well, I sent a letter to them. It goes like this:

Being listed as one of the most safest country in the world to live in outside of foolish foreigners who kill them, I once lived there for over four years. I've walked many streets in broad daylight and close to midnight. Never once feeling nervous or looking over my shoulders for thugs to steal or kill me.

Not Once. The center of all pederasts is Japan? Why do you lie about this so much? These accusation have happened because you see that they have games that show women being raped. Then assume that of course, Japanese men gear up for their daily rape-a-thons with a little bit of play thru for backing up their plans with a computer rape simulation. Have any of you within this farce of a sad joke been to Japan, have you gone there and actually researched the statistics before going off on this moral crusade to save the female population? Or are you all finding it easier to lament about Japan because it's safer to do so as compared to the rest of the world?

Your vorticity is borderline stalking tactics and intimidation on a country scale, why have you not followed on this crusade and protest the actually Killings of women across the world? Seen that movie now in the American theaters called 'The Stoning of Soraya M.'? Amnesty International has reported over eight stonings -six being on WOMEN- (so far) happening in Iran and so have you protested this to UN yet? Are you truly trying to protect actual REAL woman from dying on an almost daily basis in Africa, the Middle East, Russia, South America, Europe, North America, South east Asia, Japan and China? But most primarily in the Middle East?

Or do you all condone those killings because it is allowed by RELIGIOUS LAW in most of the Middle East and you all have to respect that? Why are you protecting figments of the imagination rather than actual flesh and blood? Is it because people are making money off it? You don't need to guess this, but many real female teenagers in Japan have been selling themselves off for escort duties because they need that new ringtone in their cells real bad. This "escort duties" range from simple dates to out right sex and Japanese directors have made movies about it since 1994! Those are Real young girls selling themselves off because of peer pressure or whim.

Please notice that last sentence and how it ends. On a "whim" will a girl sell herself off for money to buy the latest fad clothing, cell phone or jewelry. Will you protest about that too? No one Adult (Male or Female) forced those girls to do this. Will you retroactively condemn those girls from fifteen years ago?

There have been sensationalized media over the men who raped and/or killed females over the years. People like Tsutomu Miyazaki; A part of his name (Miyazaki) being an animators' name who directed a recent movie called 'Spirited Away' that won an Oscar, was found to have hundreds of video tapes of animation and slasher films. He kidnapped, raped and killed four girls back in 1984. How about Takuma Mamoru who raped a young girl and went on a killing rampage that took the lives of eight people in 2001. Mutsuo Toi; who killed over twenty-nine people back in 1936. Sakakibara Seito is the alias of a then-14-year-old student who murdered an 11-year-old boy and a 10-year-old girl in 1997. Yamaji Yukiois murdered his own mother (in 2000), a 27-year-old woman and her 19-year-old sister(in 2003). And many, many more that you can research upon if you're even slightly interested to know.

But in the end, absolutely none of them outside of the first one mentioned -a very far, far stretch by any hand- had any connection to any one computer rape simulator. Those men (and children) murdered for closer reasons outside the realms of entertainment. One admitted that after they raped one of the victims he remarked that he loved the smell and look of blood and wanted to see more! What computer rape simulation compelled that man to do this?

You and your elk have been doing this sick roadshow for hundreds of years and condemning what's easy to attack has been your primary modus operandis to make you all feel like you're making the world fit better into your perceptions of reality. It works due to fears of lose of capital most often, but due to the power of the Internet. Your scams are now laid bare for all to see. Your records are no longer hidden and history will mark you as the harlots of falsity that you truly, truly are. You have ignored the realities of the world and wrapped yourselves into a cocoon of self-righteousness rage.

History will mark you well indeed.

That'll piss their panties.. bunch of wanna-be whores!

RE: Bans imposition on adult games.
A complete ban on the adult games would spell problems for everyone. Firstly, i respect the feminist rights in protecting women and girls. However, should it be improvised, several markets will be affected. Japan, which has earned a name in adult market will suffer a decrease in its economy.
Furthermore, crimes assiociated with rape are likely to increase. "As we cannot fulfill our desires, we will have to do it to real people"

    Ya, definitely this will happen

It's astonishing how much logic twisting can be gathered in such a small text. My favorites:

"What steps is the Government taking to eliminate the promotion of violence against women through hentai and other forms of extreme pornography, including real rape videos"
I love this - it both discredits hentai by putting it in the same cathegory with rape vids, and it's also structured as if "hentai = real rape" is an unquestionable truth.

"Notwithstanding the slight increase in the penalty for rape, in order to reflect the true severity of the crime what steps is the Government taking in response to the Committee’s previous recommendation to increase the penalty for rape and what measures are in place to ensure the full investigation and prosecution of all rapes in a serious and sensitive manner?"
And, my dear feminists, what proof do you have that the current punishment is not effective? I sure hope you have pretty colored tables to go with this document or else I'm stamping it "bull shit".

"is easily accessible in Japan and its use is widely accepted"
Weasel words much? If they didn't put "hentai" in front of that, you'd think they are talking about rape.

"This latter form of hentai, known as Loli-Con"
Ok, ok, one at a time, please. Don't change topics just to make moralist crusaders more likely to support you.

"the image of women in the media, who were often portrayed as objects either of sex or violence, had a great impact"
    Umm... got proof?

"(hentai) perpetuate gender stereotypes (...) by portraying women and girls as “enjoying” being rape"
    Proof?

"required victims to give proof that they had fiercely resisted"
Well, what do you want? A woman pointing her finger and calling "rapist" to automatically result in 25 to life? Wait, don't answer that.

    "had been severely intimidated"
Criminals often try to intimidate their victims in court. The law has nothing to do with it. And neither does hentai tbh.

"depiction of one or more girl-children"
What about "boy-children"? For an organization that has "equality" in it's name, you sure don't mind discrimination.

"its obligations under Article 5(a) of CEDAW"
More weasel words. The government is under no obligations without solid statistical data to back up your claims.

"to address the broader issue of the stereotyped portrayal of women in these games and promotion of violence against women generally"
More weasel words. But putting "violence" and "these games" in the same sentence sure makes it look more convincing so who cares?

"has suffered an unprecedented hate mail"
Which is related to legality.... how? If your methods are unpopular among the people, you have only yourselves to blame. Take it to court if you have beef with the hate mail.

    "videos that appeared to depict"
More weasel words. Disturbing as it may be, there is no reason to believe the vids wasn't copied out of an AV.

"but the (police's) lack of initial response serves to underline the Committee’s expressed concern"
I'm confused. What does the committee have to do with the police?

"women’s apparent reluctance to seek assistance from existing public institutions"
    Proof?

"(EOCS) has just banned its members from producing games containing certain forms of sexual violence against women"
They banned rape just as you wanted. Under YOUR pressure. In a highly undemocratic fashion. But putting that aside, they are not legal authority and their decision is unimportant.

"(game studios) have apparently decided to prevent people from outside Japan accessing their websites in an effort to reduce criticism"
Read the fucking message on the said websites. There is a huge difference between "reduce criticism" and "protecting corporate intrests", which do not necessarily overlap.

"it is the responsibility of the Japanese Government properly to address the objectification of, and violence against, women"
Be that as it may be, you still haven't managed to prove link hentai with real violence.

    Gotta love lawyers, ne?

The National Research Institute of Police Science in Japan had found that, despite the spike in availability of pornographic material in the country, sex crimes were declining. Looking at Japan, the major problem with sex crimes is not that hentai is spawning sex offenders, but that the country's judicial system is completely unsympathetic to sex crime victims, sometimes even going so far as to blame them for their misfortune.

It often makes me wonder what groups like Equality Now are all about. They don't seem to be tackling any significant issues that truly are an adverse effect on women throughout the world. Instead, they'll waste their donated money to hire some big-time actress to star in their ads and attack the most sensationalist topics for more funds.

I wonder how many people here bothered reading the original version, lol.

Pornography depicting rape's still pretty easy to find I think, in the West, so I'm not sure how strongly the UN could push that agenda without creating a disturbing double standard. But then again, the UN's only useful for worthless things like that.

More importantly is their clause about changing Japanese laws. I think their suggestion to review the penalty of rape (minimal 3 years isn't much for rape, if min. 5 is for robbery, supposedly) sounds reasonable enough, at least on their paper. I'd have to check what the Japanese laws actually say, and how it's actually applied.

Most importantly is their suggestion that the Japanese court's diligence in having women "prove that they resisted" is a bad thing. This, completely blows my mind. If women were allowed to be raped and not resist, but still be able to prosecute someone, what on earth is going to stop women from randomly prosecuting people?

Though, with that said, provisions would have to be made to account for rape done via date-rape drugs and the like (though honestly, I don't know how many rapists actually do it while they're unconscious, since I've never read much info on that stuff).

    Generic Email Create:

    Dear Equality Now:

It stuns me to see that you are going to lengths this far to attempt to ban hentai and other forms of animated pornography by petitioning the UN to force Japan to make such things illegal. I am speaking to you as a fan of hentai, and yet also as a detractor of real life violence and rape, a dichotomy that you seem to believe is impossible for a person to hold. And yet, by deciding that all people who view animated pornography are misogynistic rape lovers, you enforce the same discrimination on an entire group of people, the same kind of discrimination that you claim to seek to eliminate.

I will grant you that some of the more provocative responses may have lead you to believe that this was the case, but you've also discounted sensible arguments and justly posed questionings of your rationale. You claim that you are not engaging in a war against pornography, and that "many also conflated Equality Now’s campaign to the opposition to sex." and yet how can you claim that their displeasure is misplaced when less than a day later you make the statement that "Japan is a nation which accepts hentai. This encourages rape so hentai must be banned." as if to allude that all animated pornography, written or drawn, must be centred on rape, when this is simply not the case. As with all pornography found everywhere, hentai covers a wide range of genres and subcultures, not just rape as you would claim.

You're lack of willingness to also see the legitimate points that people are trying to make is also mind-boggling. You attempted to provide evidence that the amount of rape in Japan was the largest in the world per capita, and yet when given statistics from multiple sources that proved how blatantly false these claims were, you backpedal and claim that those statistics are not legitimate, and then most frustratingly of all go on to claim that it is the lack(!) of evidence that provides you with the support you need, because people are seemingly "too afraid" to report rapes.

Above all, I am saddened and disappointed at the amount of time that you have spent on this issue, when there are many other more legitimate and pertinent problems that face women around the world today. You seem to be caught up in advocating for the rights of women that do not even exist in the technical sense of the word, claiming that their demeaning treatment paves the way for real life examples of such. Yet while you fight this battle REAL women are still being religiously, politically and socially repressed by traditional and governmental regimes elsewhere throughout the world. One would think that the concerns and plight of actual women would be of more value to you, but apparently this is not the case, and this is what I find the most disturbing of all.

That being said, I realize that you will probably not take this address seriously, but since you seem to believe that you hold some sort of moral and rational high ground on this issue, while at the same time grossly misrepresenting the facts and importance of said situation, I cannot help but speak out against what I myself view as a bigoted and ignorance based attack on a culture that does not deserve such treatment.

Considering that the UN barely has the authority to intervene in failed states like Sudan, let alone a first world major economic power, I really don't see what exactly it is they expect the UN to do. Their directives are routinely ignored, they can't override state sovereignty and they're certainly not going to send in the blue helmets. Although if I were running a hebtai company I'd try to relocate to America where there's much less caving in on freedom of speech issue. If they're so concerned about rape they'd go after the sex slave trade in eastern Europe, but I guess demanding the UN to obey them is easier than asking the same of the Russian mob.

Women should not have to resist sex to be able to call it rape.

THEN WHAT'S THE FUCKING POINT? It's pretty obvious thats it's not a rape if she doesn't resist? I think every country should follow Japans example of judgement system about rapes. It's a fact that women are fucking sluts, and that's why they don't resist. They know that in the end, it's very easy for them to put a accusation of rape and come away with a succesful prosecution. It's really just a game to earn money for them.

"Will you support the idea than politics will side with us and oppose a hysteric herd of moral war-mongering feminists?"

YIf they receive enough letters, yeah. There are many news articles in US papers that support freedom of expression in media.

    "You are very naive NotAnon."

At least I'm not a naive generic "anon".

"Just let them know that a lot of people are disgusted by their propaganda. Particularly the few EN that still think they are fighting for “Equality”."

What do you think that will do? Do you really think they will suddenly change their opinion on this and write an article along the lines of "Dear readers, we are sorry that one of our recent plans to censor Japanese porno games has offended so many people. We have received many letters hoping that we are raped and killed. Through hate mail like this, we have seen the error in our ways. Sorry readers! We won't let it happen again!"? All you are doing when you write them is enforcing that their opinion on hentai is true. How do you expect that writing hate mail to a group that believes you are already dangerous will help you?

"Other well thought actions would be welcome too."

Like what? Following up with the letters and sending them dead flowers in the mail? (or possibly something that actually would, you know, not reinforce EN's beliefs?)

"(Excuse me for my poor english)"

Your English actually isn't that bad. ^_^ It's a hell of a lot better than most comments here.

Lol, trying to ban hentai? Are you kidding me? These days, hentai isn't even limited to Japan anymore. Developers in other countries have taken up the torch and are producing their own eroges. Good luck with that.

This whole thing stinks of Prohibition-style utter stupidity. Even if they manage to shut down the big producers, Illusion, Key, Ailsoft, etc., all that will happen is a huge boom in independent groups and doujinsofts. I doubt they have the resources (nobody does for that matter) to patrol the whole of the internets and keep an eye out for every single hentai site. I can think of over a hundred off the top of my head, and that doesn't even include artists on Pixiv and Mixi.

In short, trying to ban hentai is like trying to stop the weeds on your lawn from popping up all the time. You can weed them and spray chemicals all you want, but short of paving over the whole damn thing with concrete, they're still gonna keep appearing. Same with hentai, or any other form of free speech, for that matter. Short of an absolutely iron-fisted kill-all-who-oppose-us approach, they can never completely get rid of the industry, and shouldn't even really try. Focus their efforts on something more worthwhile, like raising support for third-world countries or helping homeless kids or some shit.

    Leave our boobies alone, dammit!
