13-Year-Old Mentally Disabled Lolita Seduces 71-Year-Old

An elderly man arrested for sexually assaulting a schoolgirl protests that the mentally disabled girl in fact led him on like a precocious young Lolita.
The 71-year-old “unemployed” man, a resident of Kyoto, is accused of approaching the girl on the street, and calling out to her. She ignored him, so he came up behind her and pushed her over, and then somehow lured her back to his home.
Once he got her home, he mildly ravished her, touching her nether regions.
The elderly lolicon admits to touching the girl, but adamantly maintains “She enticed me into taking her home with me.”
When confronted with the fact of her being mentally handicapped, he retorts “I didn’t know.”
His crime came to light after the girl and her mother reported the matter to police.

This article sounds sketchy and questionable.

That looks like assault on his part, not her leading him on.

That looks to be the writer attempting to cast disrepute on the man. Isn't he old enough to be retired? But using the word 'unemployed' makes it seem as though he's some bum/slacker/good-for-nothing.

As other posters have commented, it's not always obvious. It's not like there's a box on their ID card (well, in Japan, there might be, but it's not the case in the U.S.) which says, "[X] Mentally handicapped - do not have unmarried consensual sex with under penalty of law."
There was a similar case in the U.S. (no loli involved) where a woman seduced a man, they had sex, and he ended up being arrested because.... she was mentally ill. Her 'sexually free' personality was in control when she seduced him, but her 'prudish' personality was in control (and remembered the events, and was horrified that she'd done such a thing) when she reported him.
Again, there no "[X] Crazy Person" checkbox on ID cards in the U.S. There was no way for him to have known.
The District Attorney prosecuted because he'd have the outraged "Think of the [insert group name here]!" action groups on his back.
I'm not saying children, mentally handicapped, or mentally ill people shouldn't be protected - they should. But there has to be a way for someone to know _in advance_ whether having sex with someone is illegal or not, some way of knowing which doesn't brand the protected person (or their ID card) with a scarlet "M", which in turn would lead to discrimination against them (Would you want to hire someone who had the red "M" of "mentally ill" on their ID card? Even if they can do the job?).

One also has to take in account that this 71 year old despite most likely be lying may actually be telling the truth. Often those that are mentally disabled are extremely intelligent in other fields. Perhaps seduction was one of them? Who knows perhaps this mentally disabled child did know what they were doing or perhaps they asked for it without knowing? To be honest there should be no way to tell outside of a direct confession from the old man. Mentally disabled minds are quite different than those which are not and anything is possible.
