    The reason i say its plagiarism in this case is the poitioning of the leg, the body posture is one thing, but for the legs and foot to have the exact same position is hard to beleive by coincidence.

    1) Not plagiarism. Referenced.
    2) Probably referenced, but even if not that's a terribly cliché pose, combined with a terribly cliché scene. So it's far from unlikely that someone would use that pose in a scene from that angle without having seen the photo. But they probably did, considering the arms.

    No, it is actually better to use reference.

    And it pisses me off when non-artists make posts bitching about the use of reference and call it plagiarism.

    Unless you blatantly trace over an image, or you use another persons art, then it isn't plagiarism.

    Graphic designers make vector art by tracing over the colors in reference images to make something photo-realistic but still not a photo, that is far worse than someone making a drawing off of it. If you're going to bitch about an artist using a photo so they have a pose and anatomy in order to make it look correct, then draw something with no reference, post it here, and let us laugh at you.

    C'mon, this is massively photo-reffed, way over the top. It looks to me like the only reason it isn't more like the original photo is because the artist is too shitty to even be able to do a decent tracing job.
    In America it would be actionable, and probably in Japan, too. The creator of The Silent Service had to pay up quite a bit of dough for his overuse of photoref and the case set a precedent over there.
    And, sorry to say, plenty of artists have enough skill that they can indeed draw figures and scenes right out of their own heads, without needing to, say, build a space colony, photograph it, and copy that.

    But I like the thicker legs and tighter sukumizu in the 2D one. Thicker legs mean bigger ass. :3 And I don't think legs like that are so unrealistic, it's just part of the body type... perfect for the hourglass figure.

    Why do fans get angry at the player in a sport when that player is doing bad? Right, because they want to see the person do better. Should the fans be playing that sport in order for them to have a right to critique that player? NO, because sports are played to entertain the fans.

    You're bitching about people critiquing someone's (poor rendition) of a 3D reference. Just who the fuck do you think the artist drew that for? Obviously not for "struggling freelancers" like you. He drew that to sell it to people who probably aren't all that capable of artistry, but will most likely will want something to fap to. And from the general consensus of the comments here, he wouldn't be able to sell his drawing because of the reasons people stated in the comments for this article, i.e. they added too much "fat" to the 2D rendition of the 3D reference.

    And even if we didn't have a 3D reference to compare it against, I'm pretty sure a good number of us wouldn't want to buy something like the 2D rendition because of the same reasons.

    Come on man, don't get butthurt over people critiquing a PUBLICALLY POSTED PICTURE. The artist obviously has a fetish for women with extra meat to their bones, but he will probably have to address that fetish if he wants to sell his art to those who want slightly slimmer women in their art.

    here's a little secret we artists have.

    if you dont do things like this then your drawing wont get an better. seriously, do you some people think that artist just suddenly become good at anatomy and be able to draw whatever the hell pose and angle they want?

    doing this is not plagarism, if it was then every artist would be guilty of it. it is called using a reference, and even the best artists in the world still uses them from time to time.

    It's not all too uncommon for artists [manga and even painters alike] to use models or real life references. I don't think it's utter plagiarism. It's not entirely different from going to a park and drawing how the place looks at the moment you're there or say, from getting a flash of insight for a plot for a manga while strolling the park and observing people.

    The only difference is that the mangaka took this from a photo which is probably copyrighted. The author should've at least asked permission or informed the original photographer or model though that is on the ethical side of it. I don't think there's any illegality to his act though.

    a straight trace... plagerism... an exact replica of a scene from another series/movie... plagerism... drawing from referances.. just fine, lots of fan art is that way, even traced... but they don't push it out as there own stuff... that would be plagerism...

    A lot of artists have been doing that. There are even some present in popular anime like Naruto who copied or "paid homage" to Cowboy Bebop and Jackie Chan respectively.

    I agree with you on this one. Photo references are used very often by artists. And, unless you are fortunate to have your own model, it's one of the very few ways to find out how something looks at a certain angle.

    I think a lot of people voting just chose the funnier option. I did. I mean, yeah it's obvious, obviously. I'm just thinking "why is this even a question? lo1". Though I don't find it so wrong. It's an industry norm and not exactly plagiarism. Some artists keep clippings of models from ads and crap even. It's easy photographs for reference. If it was 2D copying 2D though, a mangaka copying another mangaka, I'd feel it was wrong for sure.
